이 연구는 ｢아동의 권리에 관한 협약｣에서 강조하는 ‘가정 기반 보호’ 원칙을 바탕으로, 한국의 아동보호체계에서 사례결정위원회의 역할과 제도적 의의를 검토하고, 서울시 A구 사례결정위원회의 회의록 분석을 통해 그 운영 실태를 알아보았다. 2021년 도입된 지자체 사례결정위원회는 공공 중심 아동보호체계로의 전환을 상징하는 핵심 제도로, 아동의 분리 보호 여부와 대안 양육 방식에 대한 공적 판단을 수행한다. 다양한 전문가가 참여하는 사례결정위원회는 아동보호전담요원의 의견에 기초하여, 아동 최상의 이익과 가족 기반 보호 원칙을 반영한 결정 과정을 구조화한다. 실제로 A구 사례결정위원회의 3년 6개월 간의 회의록을 살펴본 결과, 회의 정례화를 통한 제도적 안정화, 아동보호체계 변화에 대응하는 발전, 아동의 의견 청취를 위한 노력 등을 확인할 수 있었다. 향후 심의 체계의 구체화 및 표준화, 아동 참여권 실현을 위한 노력 등이 지속된다면, 사례결정위원회의 실질적 기능 강화에 도움이 될 것이다.
Abstract
This study examines the role and institutional significance of local case determination committees within the child protection system of the Republic of Korea, grounded in a child rights-based approach and the principle of family-based care as emphasized in the Convention on the Rights of the Child. The study further explores the institutional framework and operational practices of the Case Determination Committee by analyzing the meeting records from District A in Seoul. Introduced in 2021, the local Case Determination Committee serves as a key mechanism symbolizing the transition toward a public-centered child protection system, by making formal decisions regarding the separation of children from their families and the provision of alternative care arrangements. Composed of various experts, the Committee structures its decision-making process based on the assessments of child protection officers, while reflecting the best interests of the child and the principle of family-based care. The analysis of three and a half years of meeting records in District A reveals institutional stabilization through regularized meetings, responsiveness to developments in the child protection system, and efforts to uphold children’s right to be heard. Moving forward, the continued refinement and standardization of the deliberative framework, along with measures to realize rights of the child to participation, are expected to contribute to the enhanced effectiveness of the Case Determination Committee.
