장애인의 범죄피해 현황과 범죄 두려움에 관한 고찰

본 연구는 전국 장애 추정인구 약 273만 명의 장애인 범죄예방 및 범죄 두려움을 감소시키기 위한 방안을 논의하고자 한다. 이를 위한 연구방법은 장애인의 안전 욕구에 관심을 갖고 장애인의 범죄피해 현황과 혐오범죄, 범죄 두려움 영향 요인 등에 관한 문헌 고찰과 언론보도 자료를 수집하여 실시하였다. 연구결과를 살펴보면 다음과 같다. 첫째, 장애인 대상의 인권침해, 혐오범죄를 포함한 범죄피해가 가족구성원과 지역 주민, 복지시설 관계자에 의해 지속적으로 발생되고 있다. 둘째, 장애인 범죄피해자에 대한 실태조사와 선행연구가 미흡하다. 셋째, 장애인의 범죄 두려움에 영향을 미치는 요인으로 일반적 범죄 두려움에는 성별, 취약성 인식, 직접 범죄피해경험, 물리적 무질서, 사회적 무질서, 사업체수, 집합효율성, 경찰신뢰와 경찰활동 요인이 있고, 이타적 범죄 두려움에는 연령, 취약성 인식, 직접 및 간접 범죄피해경험, 사회적 무질서, 사업체수, 비공식통제참여 요인이 있다. 마지막으로 구체적 범죄 두려움에는 연령, 학력, 취약성 인식, 물리적 무질서, 사회적 무질서, 사업체수, 지역사회 경찰활동 요인으로 나타났다. 이러한 연구결과를 근거로 장애인의 범죄피해 사례를 분석하기 위한 기존 실태조사의 수정 및 보완이 요구된다. 그리고 장애인에 대한 부정적 인식과 태도에 대한 적극적인 교육 프로그램으로 인권감수성을 향상과 범죄 두려움에 대한 영향 요인을 근거로 맞춤식 개입 방안을 모색해야 할 것이다. 본 연구는 사회적 약자인 장애인의 안전 욕구에 관심을 갖고 인권침해, 혐오범죄 등과 같은 범죄피해 현황과 범죄 두려움에 관한 선행연구를 살펴보고 그에 따른 문제점을 제시하면서 장애인의 범죄 두려움을 감소시키기 위한 방안을 모색했다는 점에서 연구의 큰 의의가 있다.
Abstract
This study set out to provide basic data for safety policy plans for the population of the disabled, which is estimated to be approximately 2.73 million across the nation, and search for measures to prevent their victimization and reduce their fear of victimization. For those purposes, the investigator took interest in their safety needs and reviewed the literature about the current state of their victimization, hate crimes, and influential factors of fear of victimization. The findings were as follows: first, the disabled were constantly subjected to crimes including the violation of human rights and hate crimes committed by their family members, residents, and welfare facility staffs. Second, there was a shortage of research on the actual state of victims with disabilities and also previous studies on them. Third, the factors influencing their fear of crime were categorized according to general, altruistic, and specific fear of victimization: their general fear of crime was affected by gender, perception of vulnerability, direct experiences of victimization, physical disorder, social disorder, number of businesses, collective efficiency, trust in the police, and policing; their altruistic fear of crime was influenced by age, perception of vulnerability, direct and indirect experiences of victimization, social disorder, number of businesses, and unofficial participation in control; and finally, their specific fear of victimization was influenced by age, educational background, perception of vulnerability, physical disorder, social disorder, number of businesses, and policing in the community. There is a need to revise and supplement the old investigations into the actual state of victimization among the disabled based on those findings to analyze their victimization cases. It is also needed to develop active education pro-grams to address the negative perceptions of and attitudes toward the disabled by searching for customized intervention plans based on the improved human rights sensitivity and influential factors of fear of victimization. The present study holds huge significance in that it provides theoretical and practical implications to take interest in the safety needs of the disabled, who are the weak in the society, examine the current state of their victimization including the violation of human rights and hate crimes, review the previous studies on their fear of victimization, identify problems accordingly, and make safety policy plans for them.
