담론 충돌, 제도 변화, 그리고 국회의원 표결 분석: 어린이집 CCTV 설치 의무화 쟁점을 중심으로

본 연구는 2015년 어린이집 CCTV 설치 의무화를 규정한 『영유아보육법』개정안을 둘러싼 사회적 논란과 제도 변화, 그리고 국회의원의 표결 행위를 실증적으로 분석한다. 이를 위해 어린이집 CCTV를 둘러싼 담론의 성격과 논쟁 과정을 정리했다. 특정 쟁점에 대한 상이한 담론의 등장, 그리고 특정 담론이 어떠한 조건에서 제도 변화를 가져오는지를 논의했다. 다음으로는 개정안을 부결시켰던 2015년 3월 3일 본회의 표결을 대상으로 국회의원의 투표행위를 실증적으로 분석했다. 연구 결과로부터 몇 가지 결론을 도출할 수 있었다. 첫째, 의원들의 투표 행위는 이념이나 소속 정당, 혹은 지역구 이익의 영향을 받는다. 특히 이 연구 대상인 인권 문제의 경우 이념의 영향력이 컸다. 둘째, 그러나 특정 법안에 대해 국민의 다수가 찬성 혹은 반대할 경우, 의원들은 이념이나 소속 정당 요인보다는 여론을 고려한 투표를 한다는 점이다. 마지막으로 사회 문제를 해결하기 위한 특정 담론이 제도 변화를 가져오기 위해서는 ‘초점사건’의 발생과 몇 가지 우호적인 상황이 조성되어야 한다는 사실이다.
Abstract
This paper analyzes the social discourses, policy change, and representatives’ voting behavior regarding the Infant Care Bill of 2015 which articulated the mandatory installment of CCTV inside the daycare centers to prevent child abuse. But the introduction of the bill caused social controversies and conflict between organized groups advocating their policy position based on different understanding of human rights. This paper scrutinizes this political process and empirically analyzes the voting record of members of the National Assembly on the Infant Care Act of 2015 to find the determinants of their voting decision. The result shows that the party and member’s ideology are the most important determinants of the voting choice. It also suggests that policy change can be made by a focusing event, demands of organized interests and the legislators’ sense of the national mood.
