초록

Despite the prevalence and importance of thebroadband Internet in the United States, the FederalCommunications Commission’s regulatory approachremains quite unsettled. In 2010, the FCC adopted“Open Internet Rules,” designed to promote networkneutrality. But while a federal court has upheld theFCC’s authority to regulate broadband, the courtalso held that nondiscrimination rules go beyond theFCC’s power. This paper discusses the FCC’s approachesto network neutrality and considers otherU.S. institutions that may address discriminationissues on the Internet. The paper concludes thatthe U.S. Internet ecosystem remains fundamentallyopen, but that openness faces coming challengesfrom the development of carrier-managed services and the imbalance of traffic delivery between content providers and access networks.
