경제규제행정법이론은 공동체의 희소한 자원의 배분문제에 있어서 국가 혹은 정부 의 역할과 기능의 내용과 범위를 다루는 법이론이다. 경제규제행정법이론을 이렇게 이해한다면, 경제규제행정법의 내용을 입안하고 집행 하는 국가 혹은 정부의 역할은 시장의 기능과 역할과의 상관관계 하에서 이해되어야 하고, 경제규제행정을 평가하는 가장 중요한 기준은 경제적 효율성이 될 수밖에 없다. 시장이 어떠한 영역에서 어떤 원인으로 공적인 자원배분문제의 해결에 실패하게 되 는지, 그 실패의 교정을 위해 국가행정작용은 어떤 방식으로 어떤 범위까지 개입할 필 요가 있는지 등의 문제가 경제규제행정법이론을 전개함에 있어서 항상 염두에 두어야 할 주제이다. 이 논문에서는 경제규제행정법이론을 설명하는 이론으로 공익이론, 포획이론, 규제 에 관한 경제적 이론, 이렇게 세 가지 이론의 내용을 살펴보고, 이론을 통한 현실설명 력의 관점에서 각 이론의 장단처에 관해 검토하는 시도를 해보았다. 전통적인 경제규제행정법이론은 경제규제의 발생근거에 관해 시장실패가 발생하는 영역에서 시장실패의 교정을 위한 것이라는 공익이론, 규제가 만들어지고 집행되는 과 정에서 규제입법자와 규제행정청이 피규제자인 산업부문에 포획되는 경향이 있다는 포획이론 등의 설명수준을 벗어나지 못하고 있었다. 그러나 공익이론과 포획이론은 현실에서 실제로 만들어지는 규제의 내용에 관해 충 분한 이론적․실증적 근거를 제시해주지 못하고 있다. 이 논문에서는 경제규제의 실제에 관한 보다 정확한 이해를 위해서는 도그마틱적인 법이론의 정립보다는 경제규제의 현실과 이론에 관한 경제적인 분석이 필요함을 지적 하고, 규제에 관한 경제적 분석으로서 Stigler/Pelzman 모델과 Becker 모델을 살펴봄 으로써 보다 현실설명력 있는 경제규제행정법이론의 발전방향을 제시하고자 하였다.
Abstract
The theories on economic regulation address the problem of how to establish the rules on the redistribution of scarce resources in our society. If we define the theories on economic regulation as such, then we have to understand economic regulation in relation to the role of market system and economic efficiency should be the main criterion to evaluate economic regulatory rules. There can be three categories of theories on economic regulation. First, the Public Interest Theory explains that economic regulation is made in the field of market failure to correct that failure. Secondly, the Capture Theory explains that economic regulation is the outcome of capture of legislators and regulatory agencies by the industry which is the main object of regulation. Those two theories have many empirical evidences which fit to the explanations of each theory. There are, however, also large amounts of other empirical evidences which do not fit to the explanations of the two theories. Moreover, those two theories lack the theoretical underpinnings. In this sense, it is necessary to establish theory on economic regulation in the perspective of economic analysis. In this paper, I reviewed Stigler/Pelzman model and Becker model on economic regulation. By reviewing the economic theories on economic regulation, I have tried to show that it is necessary and essential to have economics perspective on regulation to better understand the real features of economic regulation in reality.
