Abstract
It is one of the most urgent challenges of our times to address human rights abusescommitted by multinational enterprises (MNEs). Considering that OECD Guidelinesfor Multinational Enterprises (hereinafter ‘the Guidelines’) are one of the mostimportant instruments in tackling the issues, this paper tries to clarify the meaningsof the current Guidelines and to peep at its future by reviewing its past developmentalprocess, and eventually to answer on what ground the Guidelines merit ourattention and what additional measures are needed for further development of theGuidelines. The first Guidelines, enacted in 1976, had nothing to do with general humanrights issues except for labor rights. It was not until the amendment of theGuidelines in 2000 that the term “human rights” was inserted into the Guidelines. Inthis amendment the Guidelines also expanded its jurisdiction to include not only thehuman rights violations caused by MNEs in non-member (or non-adhering) countriesbut also the violations caused by other business entities with which MNEs had businessrelations. In addition, new procedure was introduced which authorized the NationalContact Point (hereinafter ‘NCP’) to implement dispute settlement processes named‘Specific Instances’. The 2011 amendment of the Guidelines corrected the somedefects of the 2000 Guidelines and added an independent human rights chapterwhich mirrored the UN Framework on Business and Human Rights (2008), makingthe Guidelines the most advanced human rights norm on MNEs with implementation procedures in the international public law system. This article finds that the key feature in the evolutionary development of theGuidelines is the emergence and strengthening of the NCP as an dispute settlementbody with adjudicative authority in relation with human rights violations committedby MNEs. It is true that we still have to wait to find the current adjudicative functionto reach our satisfaction, but its potential cannot be underestimated. Conclusively itis proposed that the adjudicative function of the NCP should be strengthened as apriority in the Guidelines’ development and that the same approach should be adoptedin the current discussions on the Korean NCP reform.
