사업장 근로감독의 실효성 제고 방안 : 행동경제학적 대안을 중심으로

노동보호법의 집행은 대부분 근로감독을 통해 이루어진다. 근로감독은 형사사법을 최종수단으로 하며 근로감독, 행정지도 등 비교적 탄력적 수단으로 문제를 해결하고 있다. 사업장 감독은 근로감독제도의 가장 핵심적인 수단으로 오늘날 사업장 감독이 안고 있는 문제점은 낮은 적발건수와 적발률이다. 이처럼 낮은 수준의 감독결과는 근로감독의 위하효과를 기대하기 어렵고 기업의 자율적인 노동법 준수 의지를 약화시킬 수 있다. 이 논문은 행동경제학 관점에서 근로감독 정책의 활용방안에 대하여 살펴보았다. 특히, 사업장 감독의 비효율성 및 비효과성의 원인과 문제점은 근로감독제도의 운영에 있음을 밝히고 있다. 고용노동부 노사누리시스템의 비대면 ‘전자결재’ 방식은 감독과정에서 상호 커뮤니케이션을 통한 의사결정이 어렵고 내부통제 시스템이 작동하지 않는 부작용을 초래하고 있다. 또한, 사업장 감독과정에서 ‘완전시정’ 시스템은 업무부담, 평가 등을 이유로 시정이 쉬운 경미한 법 위반사항 적발에 그치거나 아예 적발을 기피하게 만들 개연성이 높다. 행동경제학에서 말하는 ‘넛지’라는 부드러운 개입 혹은 간섭이라는 접근방법을 통해 적발건수와 적발률을 높여 사업장 감독효과의 제고를 기대할 수 있다.
Abstract
The enforcement of labor protection laws is mostly carried out through labor inspection. Labor inspection uses criminal justice as the final means and solves problems through relatively flexible means such as labor inspection and administrative guidance. Workplace supervision is the most core means of the labor inspection system, and the problem of workplace supervision system today is the low number of detections and detection rates. Such a low level of supervision results makes it difficult to expect a negative effect from labor inspection and may weaken a company's will to voluntarily comply with labor laws. This paper examines policy applications regarding labor inspection from a behavioral economics perspective. In particular, it is revealed that the causes and problems of inefficiency and ineffectiveness of workplace supervision lie in the operation of the labor supervision system. The non- face-to-face ‘electronic approval’ method of the Labor-Management Nuri System of the Ministry of Employment and Labor is causing the side effect of making decision-making through mutual communication difficult and the internal control system not functioning during the supervision process. In addition, the ‘complete correction’ system in the workplace supervision process is highly likely to limit the detection of minor violations of law that are easy to correct or to avoid detection altogether due to work burden, evaluation, etc. Through a soft intervention or intervention approach called ‘nudge’ in behavioral economics, it is possible to increase the number of detections and detection rates, thereby improving the effectiveness of workplace supervision.
