엄정하고 신속한 기용품 통관제도에 대한 시론적 연구: 한국, 일본, 홍콩의 비교를 중심으로

무역자유협정의 확대, 국가 간 여행객의 증가, 전자상거래의 성장 등은 국제항공편의 운항 편수를 비약적으로 증가시켜왔다. 국제항공편의 운항 편수가 급격하게 증가했다는 사실은 대량의 기용품이 국내로 반입되는 동시에 국외로 반출되고 있음을 의미한다. 따라서 대규모로 반입 또는 반출되는 기용품을 신속하게 검사하는 동시에 외국산 불법물품과 위해물품의 국내 반입을 엄격하게 차단할 수 있는 기용품 통관제도의 필요성은 나날이 커져 왔다. 본 논문은 기용품 통관제도를 연구한 최초의 논문으로서, 현행 기용품 통관제도의 개선방안을 탐색하는데 그 목적을 두고 있다. 특히, 기용품 통관제도에서 중시되는 신속성과 엄정성이라는 상반된 가치를 어떻게 조화롭게 조율할 지를 모색하는 것에 주 관심을 두고 있다. 이러한 목적을 달성하기 위하여, 한국, 일본, 홍콩에서 운영 중인 기용품 통관제도를 비교분석한 후, 일본과 홍콩의 기용품 통관제도에서 신속성과 엄정성을 동시에 구현하기 위해 활용하였던 제도적 조치들을 한국의 기용품 통관제도에 적용하는 정책 방안을 제언하고자 한다.
Abstract
The rise of the Free Trade Agreement, the upsurge of international travelers, and the growth of e-commerce dramatically have increased the number of inbound and outbound international flights. This increase indicates that a lot of aircraft stores are loaded on outbound international flights and unloaded from inbound ones. Therefore, there is a growing need to build a customs service that can not only process the loading and unloading of aircraft stores quickly but also prevent the smuggling. However, no academic attention has been paid to the building a ‘speedy and stringent’ customs service for aircraft stores. The purpose of this article was to examine how to improve the customs service for aircraft stores in Korea. Special attention was paid to the establishment of a ‘speedy and stringent’ customs service for aircraft stores in Korea. To accomplish this purpose, we conducted a comparative study on the customs service for aircraft stores in Korea, Japan, and Hong Kong. Especially, we focused on searching for best practices in Japan and Hong Kong, which attempted to balance the speediness and stringency of customs service for aircraft stores, and proposed several policy recommendations for how to ‘transplant’ those best practices in the Korean customs service for aircraft stores.
