한국 사회보험의 특수성과 과제

이 글은 한국사회보험의 특수성과 과제를 규명하고자 한다. 한국 정부는 근로자 집단을 포함하는 국민의 사회보장을 위해서 강제 사회보험제도인 산업재해보상보 험, 국민건강보험, 국민연금 그리고 고용보험을 차례로 도입하여 운용하고 있다. 이는 재정방식에서 조세가 아닌 보험료를 재원으로 삼고 있다는 점에서 사회보험으로 분류될 수 있다. 이제까지 이해관계의 대립 속에 있던 노동자와 고용주가 강제사회보험제도를 통해서 연대의식으로 뭉쳐진 하나의 자조집단이 되어서 산업재해, 노후. 건강, 실업 등등의 사회문제에 국가의 재정적 지원 없이 주체적으로 공동 대응해 나가게 된다는 것을 의미한다. 한국의 경우 사회보험을 사회보험공단이 운영하고 있지만, 이해 당사자인 고용주와 근로자들은 사회보험공단에 거의 아무런 영향력도 행사할 수 없다. 한국사회보험에서 자치운영원칙의 회복이 가장 시급한 과제가 된다. 한국의 국민건강보험과 국민연금은 대상 집단과 재정방식에서 모순이 있다. 이 두 가지 사회보장제도 모두 재정방식에서 보험료를 재원으로 하고 있으면서, 국민전체를 대상으로 하고 있다. 그 결과 국민건강보험은 만성적인 적자에 허덕이고, 충분한 급여를 지급받기 어려운 구조 속에 빠져 있다. 국민연금은 노동자의 적정한 노후생활보장이 아닌 “국민의 최저생활보장을 위한” 사회보장제도로 전락되었다. 이러한 한국의 사회보험이 가지고 있는 근본적인 문제점은 헌법적으로 허용되지 않는 소득재분배 체계라는 측면에 있다. 전체적으로 한국의 사회보험은 한국 사회의 중추적 역할을 담당하고 있는 중산층의 안정된 생활보장이라는 기능을 담당하는 데에 거의 아무런 영향력도 끼치고 있지 못하다. 한국의 사회보험은 향후 지금까지의 국민최저생활보장이라는 목표에서 국민들에게 중산층 정도의 생활보장을 하는 것으로 그 지향목표를 바꾸어 나아가야 할 것이다.
Abstract
This article seeks to explore particularities and problems of the Korean social insurance. Korean governments have been driven by a strong desire to introduce industrial injuries insurance, the health insurance, the national pension, and the unemployment insurance one by one. The Korean state policies can be regarded as social insurance, because they were not designed as vehicles of income redistribution, and funded not by the tax but by the insurance fees. This means that the employees and the employers form a mutual support group to deal with such social risks as industrial injury or disability, retirement or agedness, healthcare or medicare, and unemployment or joblessness, without any financial supports from the state. In Korea, the social insurance programs are managed by a number of social insurance public corporations. However, both the employers and the employees have no influence on the management of those programs, though they are immediately the interested parties. Therefore, a recovery of the self govern principle for operating the social insurance programs becomes an urgent issue in Korea. There are interest conflicts among liable groups in the national health insurance as well as in the national pension in Korea. These two social security systems financed by money from employees and employers were designed to provide the all people, as their beneficiaries, with benefits. As one of their undesirable effects, for exemple, the national health insurance has been deep chronic losses, and it will be unable to pay the benefits sooner or later. The national pension has become a social security system of the lowest living standard not a proper retirement plan. A fundamental problem with the Korean social insurance is related to its role of redistributing income, thus violating the Constitution. The Korean social insurance does not play any important role of securing the middle class's future living. Therefore, the Korean social insurance needs to change its role in order to guarantee Koreans a future living of middle class level.
