Abstract

In 2020, National Police Agency("NPA") introduces restorative justice(or restorative policing). This is very encouraging in that it offers alternative conflict resolution to a society that has lost or is losing the ability of resolving conflicts in the golden age of victims where potential victims demand the faster, the more, and the stronger intervention of State and punishment in the name of victims. Restorative Justice at the stage of Police has definite advantages in that reconciliation may be facilitated more easily because intervention is made before conflicts worsen as the process goes on. The model NPA sets up is conferencing to be committed by civil organizations, which is meant to complement not replace criminal justice system. Its operation scheme follows typical logic of purist theory. This article intends to contribute to the development of this institution by reflecting critically theoretical and practical issues embodied in the model. In terms of theory, the most important issue is that one party should admit the fact of offending at the stage of suspect or earlier. So there is no fact finding or disputes about who did what in the restorative process. This engenders the dangers of compulsory confession in exchange of more lenient sanction and of private plea-bargaining. In terms of practice, there runs risks of organizational culture in which primary goals (investigation-arrest-forwarding) and secondary goals(damage recovery, preventing reoffending) may conflict. This entails issue of police roles and discretion that the society expects. In our society where police discretion is near null, I suggest that police discretion with regard to restorative justice should be institutionalized so as to ensure effectiveness and to prevent abuse. And I believe that NPA should consider commiting conferences rather on its own than by other organization at some point. To avoid this project's degenerating into the benign cloak with which consent is secured with regard to zero-tolerant harsh punishment policy, but to contribute to re-activate disappearing way of informal conflict resolution, we need not beautiful rhetoric or myth of success but incessant reflection on the restorative justice philosophy, theory and practice.
