Abstract
Unlike civil-law countries, in common-law countries, law has developed independently and includes significant characteristics of feudal law, inductive reasoning using precedents, and the formation and character of jurisprudence through judgments. Such law lacks a significant correlation to Roman laws or systematic codification. As such, property law in the United States (US), which is a common-law country, was formed and developed through a different historical process than that of civil-law countries. As a result, the appearance of property law, the types and content of property rights, and individual property laws based on this have been developed. Behind its development, thoughts and theories on property law that have dominated American society since its founding continue to play an important role. In the early years, traditional theories, such as first occupancy theory and labor theory, had a relatively large influence on the formation of American property law. However, in recent years, utilitarianism, especially the theory of law & economics, has not only served as a basis for the justification of property law but has increased its presence in various research methodologies and viewpoints surrounding property law. As described above, US property law incorporates the flexibility to enable changes in the content of property rights by interacting with various theories that provide justification. Therefore, as a prerequisite for the study of comparative law on property laws in the US, an interest in and an understanding of the theoretical foundations of legal doctrines are essential.
