본 연구는 회복적 정의의 핵심 원칙인 '재통합적 수치심'에 대해 이론적으로 고찰하였다. 논의는 다음의 세 가지 주제를 중심으로 전개되었다. 첫째, 재통합적 수치심 개념을 규명하였다. 이를 위해 기존 수치심 개념과 더불어 낙인이론, 통제이론 등의 관련 이론을 검토하였다. 둘째, 브레이스웨이트가 제시한 재통합적 수치심 이론의 주요 특징을 살펴보았다. 그는 수치심을 범죄자와 공동체 간의 관계 회복을 가능하게 하는 도덕적 수단으로 설명하였다. 마지막으로, 재통합적 수치심이 도덕성과 교육과정 속에서 어떻게 활용될 수 있는지 그 가능성을 논의하였다.
Abstract
This study investigates the key principle of restorative justice—reintegrative shame—through three central themes. First, it clarifies the concept by examining existing definitions of shame and related theoretical frameworks, including labelling theory and control theory. Second, it explores John Braithwaite’s perspective on shame as a moral tool for restoring relationships between offenders and the community. Third, it considers the potential role of reintegrative shame in development and moral education.
