보호소년을 위한 회복적 교정교육 : 갈등을 넘어 성장으로

초록

처벌을 넘어 가해자와 피해자 간의 관계 회복을 추구하는 회복적 정의는 국내에서도 활발하게 논의되고 있다. 본 연구에서는 이러한 회복적 정의를 보호소년의 특성과소년원의 기능에 맞춰 구현한 회복적 교정교육을 제안하였다. 먼저, 고위험 집단이 수용된 교정 시설에서 회복적 정의 실천의 제약을 검토하였고, 보호소년이 소년원 입원이전에 경험한 다양한 부정적 사건과 소년원의 교정적･교육적 역할을 살펴보았다. 이어서, 일반 학교에서 학생과 교사의 관계 강화 및 공동체적 교육 환경 조성의 중요성을 강조하는 회복적 생활교육을 소개하였다. 검토 결과를 토대로 소년의 성장과 회복을 위한 교정교육 방안을 논하였다. 결론적으로, 회복적 정의에 입각한 교정교육이 교사와 소년 모두에게 긍정적 영향을 미칠 수 있음을 설명하였고, 장기적인 관점에서 지속적인 추진이 필요함을 제언하였다.

Abstract

Restorative justice, which seeks to repair relationships between offenders and victims beyond mere punishment, has been actively discussed in South Korea. This study proposes a model of restorative correctional education tailored to the characteristics of juvenile offenders and the functions of juvenile training schools. It first examined the limitations of implementing restorative justice in correctional facilities that house high-risk offenders. This research also explored the negative experiences of juvenile offenders prior to their admission to training schools and the correctional and educational roles of these institutions. Additionally, it introduced restorative practices in schools that emphasize strengthening relationships between students and teachers and fostering a peaceful classroom as an educational community. Based on the literature review, the study discussed educational strategies for the growth and recovery of juvenile offenders. It concludes that restorative correctional education may have positive impacts on both teachers and juveniles and emphasizes the need for a long-term approach to effectively integrate these practices into the correctional system.
