FRAND 확약이 붙어 있는 표준특허에 관련된 분쟁에 대한 각국의 판례 및 심결례의 최근 동향을 종합해 보면 어떤 경우에나 FRAND 조건에 합치되는 실시료의 산정 기준을 찾는 것이 이러한 분쟁을 해결하기 위한 필수적인 과제로 부각되지만 이 분야에 관한 국내의 연구성과를 찾기는 어려운 실정이다. 이 논문은 먼저 FRAND 조건의 정의에 의해 FRAND 조건에 합치되는 실시료의 산정 기준을 찾는 것이 가능한지 검토하고 FRAND 실시료 산정의 기준에 관해 외국에서 벌어졌던 논쟁의 동향에 관해 분석하며 실제로 FRAND 조건에 합치되는 실시료를 산정했던 미국의 판례들의 최근 동향을 분석, 보고한 문헌들의 내용을 소개한 다음 결론에서 필자의 의견을 간략하게 제시하였다.
Abstract
The complexity of standards in Information and Communication Technology (ICT) creates a tension between the need to reward the owners of Standard Essential Patents (SEPs) that may cover standard specifications and the need to make standards available to all for public use. In the last few years, this tension has crystallized into a difficult debate on licensing principles that must be Fair, Reasonable and Non-Discriminatory (FRAND or RAND). The purpose of this report is to provide a balanced account of the current controversy relating to the FRAND licensing of standard essential patents and to explore future research topics in this area.
