Abstract
In-depth comparative research on the laws of Islamic societies is notably lacking, which is unbefitting of a reputation and dignity of the Republic of Korea. This study has examined the legal systems and families of civil law of three representative Middle Eastern nations—Turkey, Egypt, and Iran—which belong to the Roman law system, contrary to the general perception. This study has argued that civil laws of Islamic societies are not significantly different from our understanding. The Egyptian Civil Code, among the three civil codes mentioned above, has exerted a profound influence on numerous countries in the Middle East and Maghreb regions. It is also noteworthy for future comparative law studies that the Egyptian Civil Code was enacted under the predominant influence of the French Civil Code. In this study, conducted as a macroscopic comparative analysis, we have limited our focus to key countries in the Middle East. Based on this study, we anticipate future micro-level comparative studies on specific topics and an expansion of the scope of countries under research. Lastly, it is essential to mention the significance of adopting a viewpoint that separates religion from scholarship when examining legal studies within Islamic societies.
