사우디아라비아의 상사중재 발전 동향에 관한 연구

초록

사우디아라비아는 걸프 지역의 문화적ㆍ경제적 중심지로서 그 중요성이 큼에도 불구하고, 이슬람법(샤리아)에 대한 편견으로 국제적 수준의 법적 판단이 적용되기 어렵다는 오해를 받아 왔다. 그러나 세계 3대 법체계인 이슬람법은 현대 경제생활에서 유연하게 적용되어 왔으며, 이는 보수적인 샤리아 근본 체계 국가인 사우디아라비아도 그 예외가 아니다. 본 논문에서는 사우디아라비아의 법체계에 대한 개관을 통해 샤리아가 법률, 사법체계의 형성에 어떠한 영향을 미쳐 왔는지, 그리고 2007년 고충해결위원회법 개정으로 사법체계가 어떻게 재구성되었는지를 살펴본다. 이어 효율적 법체계 확립, 산업구조 개선과 투자 촉진을 목적으로 진행되고 있는 사우디아라비아의 사법개혁이 중재법과 집행법의 제ㆍ개정을 통해 어떻게 실체화되었는지를 살펴본다. 1993년 뉴욕 협약의 비준에도 불구하고 그간 사우디아라비아에서는 중재가 분쟁해결의 도구로서 효과적으로 활용되지 못했다. 이러한 문제점을 해결하기 위해 2012년 중재법과 집행법의 개정이 이루어졌으며, 절차 개선, 요건의 구체화, 전문기관의 설립으로 지역 상사중재의 큰 발전을 가져왔다. 이들은 효과적인 분쟁해결의 도구로서 중재를 활용할 수 있는 기반이 되는 법률로서, 사우디아라비아와의 깊은 관계를 맺고 있는 우리나라로서는 그 발전 방향과 의의, 한계에 대해 짚어 볼 필요가 있다. 특히, 법률의 제ㆍ개정 이후 사우디상사중재원의 설립과 중재규정 반포로 구체화되어가는 과정 속에서 사우디아라비아의 개혁 의지와 추진 방향을 살펴볼 수 있으며, 향후 활용 방안을 모색해볼 수 있다.

Abstract

Though its importance as cultural, economical central country in Gulf region, Saudi Arabia has been assessed as a less-modernized country to adjust legal adjustment on international level. But Shari’a, as one of the three major legal systems in the world, has applied by flexible ways, and Saudi Arabia also not an exception to that way. This study overviews Saudi Arabian Legal System for researching how Shari’a has been affected to enactment of statute, and Legal System. And also, this study reviewed and compared latest Saudi Arabian Legal System based on revision of law of Board of Grievances to old Saudi Arabian Legal System. In succession, this study reviewed how legal reform of Saudi Arabia has been composed for establishing effective legal system, improvement on industrial structure, and promoting foreign investment, by establishing and revision of Arbitration Law and Enforcement Law. Until few years ago, arbitration has not applied as a major solution of dispute resolution even Saudi Arabia ratified New York Convention in 1993. Revision of Arbitration Law and Enforcement on 2012 was targeting to solve above problems in such circumstances, and it resulted a significant advance on them by improving procedure, amplifying requirements, and establishing a professional institution. Above improvements provide foundations for applying arbitration as a effective dispute resolution. Because of its close relation with Saudi Arabia, Korea also needs to analyze in detail like its direction, meaning, and limitations. Especially Korea can find the indomitable will to reform and its direction on the progress to implement legal revision for utilizing in the future disputes.
