고등교육 이러닝 책무성 강화를 위한 법제도 개선 방향 탐색

초록

본 연구는 이러닝을 실시하는 고등교육기관들이 교육적 책무성을 강화하도록 유도하는데 필요한 법제도적인 방안을 모색하는데 목적이 있다. 이를 위해 본 연구에서는 교육인적자원부가 2007년 발표한 최신 정책 자료들을 분석하고, 2007년 10월 17일 개정된『고등교육법』을 중심으로 관련 법령과 국내외 선행연구들을 검토하여 향후 고등교육 이러닝이 내실화될 수 있는 발전적인 대안을 제시하고자 하였다. 특히, 최근 개정된 고등교육 법령에서 나타나고 있는 규제완화 정책 기조와 교육적 책무성을 병치시킬 수 있는 방안을 모색하고자 하였다. 이를 위해 본 연구에서는 고등교육기관에서 이루어지는 이러닝이 학습자들의 학습권을 보장하는데 필요한 법적, 제도적 기반을 탐색하는데 초점을 맞추었다. 제도적인 측면에서는『교육관련기관의 정보공개에 관한 특례법』에 근거한 ‘대학정보공시제’의 활용을 통해 이러닝에 관한 학습자들의 학습권을 보장하는데 필수적인 사항들을 공개하도록 함으로써 이러닝 운영 주체가 되는 고등교육 관련 기관의 자구 노력을 유도하는 방안을 제시하였다. 공개된 정보의 유용성을 높이기 위하여 교육수요자의 정보접근성 및 정보이해도를 제고하기 위한 방안을 함께 제시하였다. 법령 개정에 있어서는 2007년 10월 17일 개정된『고등교육법』을 중심으로 이러닝 관련 조항들의 내용을 분석하여 미비한 점을 보완한 후 기존 법령에 대한 개정안을 제시하였다. 사이버대학의『고등교육법』완전 이관, 사이버대학 정원 자율화, 시간제 학점 인정, 군복무 학점 인정 등에 관한 사항에 대하여 법령 개정 방안을 제시하였다.

Abstract

The purpose of the study was to examine a way of ensuring higher education accountability for e-learning with the revisions of the current laws, regulations, and policies. E-learning in higher education is authorized and managed under the Higher Education Act. The recent law and policy revisions in higher education focused on extensive autonomy regarding e-learning without much consideration of elevating accountability, which might result in moral hazard and inefficient law enforcement. Increased autonomy does not mean absence of outside controls, quite the opposite. To ensure quality in e-learning, governments, parliaments and society at large are asking for more accountability. To achieve the research goal, I reviewed the previous research and related literatures, including government reports, I drew some useful implications to revise the current laws, regulations, and policies. With the implications, I suggested possible ways of improving the current Higher Education Act and regulations. First, I founded that the current law and regulations lacked accountability system in many ways including e-learning for part-time students and military personnel. Second, I suggested revisions on the structure and the content of the Higher Education Act and proposed some ideas about new articles for related the regulations, so that policy makers might use the idea as they revise the law.
