초중등학교 온라인 수업 도입을 위한 법제도적 과제

온라인수업은 학생 개개인의 차이를 고려한 개별화 맞춤형 학습, 과목선택의 자율성 확대, 상치교사와 도서벽지 학습자의 학습권을 보장하기 위한 것으로, 헌법 제31조에 명시된 ‘교육을 받을 권리’를 보장하는 중요한 방안이다. 정보통신기술의 발달에 따라 공교육에서의 온라인수업에 대한 필요성이나 수요가 점차 확대되어 가고 있음에도 불구하고 초중등교육에 온라인수업을 도입하는 것은 현실적으로 매우 어렵다는 의견이 많다. 그 중 가장 큰 장애요인은 온라인을 통한 수업이 교육과정상 정규 시수로 인정될 수 있는 법적 근거와 제도적 측면에서 매우 취약하다는데 있다. 이러한 맥락에서 본 연구는 초중등교육에 온라인수업을 도입하는데 제기되고 있는 법제도적 쟁점과 개선 방향을 제시하는데 목적이 있다. 이를 위해 국내에서 시행되고 있는 온라인수업의 현황을 시도교육청 운영 사례를 중심으로 분석하고, 호주, 캐나다의 사례를 통해 해외 온라인수업 운영에 대한 법제도적 시사점을 논의하였으며, 온라인수업에 관한 현행 법령 현황, 법제도적 문제점 및 개선방안을 탐색하였다. 이를 기초로 초중등교육법 및 동법 시행령의 법령 개정안과 국가 수준 교육과정 편성․운영지침에 대한 개정안을 제시하였다.
Abstract
K-12 schools should provide a more adaptive learning circumstance to meet individual's need and interest to learn at various level. One of the possible way to achieve the goal is to use online instruction, which was suggested in the「Smart Education Plan」by the Korean government in 2011. However, the current law with regard to the online instruction in elementary and secondary school is stated vaguely whether K-12 schools are able to teach by online, so that the government policy and the law do not match each other. School administrators and superintendents hesitate to employ online instruction at the K-12 schools. This study aims to suggest revisions to improve the current laws and regulations with regard to the online instruction. The current status of the elementary and secondary education law are examined, and previous case studies of online learning in public schools, both national and abroad, are examined to look for implications. Based on the implications, suggestions on substantializing online instruction are made.
