민주주의의 역설과 경계의 사유

초록

민주주의 역설에 대한 논의는 크게 두 차원으로 대별해 볼 수 있다. 한 차원에서는 자유 민주주의의 두 구성원리인 입헌주의 원리와 인민의 자치라는 민주주의 원리 간의, 인권과 주권 간의 대립을 어떻게 풀어갈 것인지를 놓고 논의가 진행되고 있다. 다른 차원에서는 이른바 ‘정치적인 것’의 회귀에 관한, 그리고 정치적인 것과 입헌 민주주의적 게임규칙을 포함하는 ‘정치’의 관계에 관한 논의가 전개되고 있다. 민주주의 역설에 관한 이 두 논의 차원은 인민의 자기지배라는 원리가 근대적 법형식이라는 칼의 문을 통과하면서 겪는 변형 및 상처와 관련된 논의라고 할 수 있을 것이다. 역설의 이 두 차원을 모두 고려하기 위해선 경계의 사유가 필요하다는 것을 보여주는데 이 글의 목적이 있다. 여기서 경계의 사유는 내재/초월의 구별이라는 틀 속에서 타당성 검사 및 정당화의 문제에 집중하는 내부의 사유와 표기(表記)/무기(無記)의 구별이라는 틀에 따라 말해진 것 속에서 말해질 수 없는 것의 흔적을 추적하는 데 초점을 맞추는 ‘바깥의 사유’를 모두 넘어서려는 사유를 말한다. 먼저 1) 민주주의 역설의 진원지를 해명하기 위하여 법치로 요약되는 법과 권력의 상호구성과 전제의 관계를 해명하고, 그 한가운데 있는 빈터를 분석한다. 2) 입헌 민주주의의 역설에 대한 하버마스의 해결방식을 미첼만과 하버마스의 논쟁을 중심으로 분석한다. 3) 하버마스의 해결책을 경계의 사유의 관점에서 비판적으로 고찰하고, 이어서 하버마스의 내부의 사유와 대립하는 4) 바깥의 사유의 사례로서 데리다의 해체적 정치를 비판적으로 검토한다.

Abstract

There are two dimensions in the debate on the paradox of democracy. The first one is about the paradox of constitutional democracy, which results from the confrontation of two principles of modern democracy; rule of law and self-government of people. The other one is about ‘the return of the political’ and its relation to politics. The purpose of this article is to show that paying due regards to both dimension and treating adequately that paradox requires ‘the thought of/on borderline’ which is characterized by the triadic structure of the transcendental / the marked / the unmarked. Beginning with analysing the void within the rule of law, I will reconstruct Habermas' solution to the paradox of democracy and show from the viewpoint of ‘thought of/on borderline’ that Habermas' solution has some deficiencies because his thought remains in the ‘thought of inside’ which reduce the triadic structure to the dual structure of the transcendental/the immanent. And then I will critically show that Derrida's deconstructive politics remains, contrary to Habermas' Thought, in ‘the thought of outside’, which reduces the triadic structure to the dual structure of the marked/the unmarked.
