장기기증에 있어서의 가족 등의 거부권- 캐나다의 장기기증법률과 관련하여 -

초록

장기기증에 있어서 장기기증의 활성화를 위하여 opt-in 방식 이외에 opt-out 방식을 취하는 경우가 늘고 있다. 최근 캐나다의 노바스코시아주가 북미대륙에서 처음으로 이와 같은 opt-out 방식을 도입하였다. 하지만 opt-out 방식의 경우에는 opt-out 의사를 명시적으로 표시하지 않았다고 하여서 적극적으로 장기기증에 동의한 것과 같다고 보기는 어렵다. 장기기증의 활성화를 위해서는 오히려 장기기증의사자의 사망 후 장기기증의사자의 의사를 아무런 제약 없이 번복, 철회, 취소할 수 있는 가족 등 제3자의 거부권의 근거에 대하여 의문을 가져야 할 것이다. 장기기증이라는 것이 장기기증의사자가 인격적 판단에 의하여 자신의 장기를 기증하기로 결심하고 그와 같은 의사를 표명한 이상 본인이 아닌 다른 제3자가 가족이라는 이유만으로 그 의사를 번복하는 것이 지나친 권한의 남용이라고 할 것이다. 장기기증은 본인의 의사를 가장 최우선적으로 고려하여야 하므로, 가족 등의 역할은 장기기증의사자의 기증의사가 번복, 철회, 취소된 경우 이를 증명하여 장기기증의사자의 본의가 반영되도록 하는 데서 그치도록 하여야 한다.

Abstract

Many countries have increasingly adopted an opt-out organ donation system for organ transplantation instead of the previously employed opt-in system. For example, recently, the new legislation of the opt-out system was enacted in the province of Nova Scotia, Canada, as it is the first legislation in North America. However, it is hard to say that the presumed consent can be regarded as the explicit and informed consent when the donor has not explicitly expressed his/her intention to opt out. Otherwise, one of the biggest problems interfering with organ transplantation is the family’s right to override, cancel, or withdraw the donor’s intention without restriction. The donor’s decision that was made after a fully informed consideration should be respected and upheld by everyone, including the donor’s family. The role of the donor’s family should be limited to proving and reflecting the donor’s true intention with evidence, should the donor change, cancel, or withdraw his/her intention for organ donation.
