국제채권양도협약의 적용범위 2001년 12월에 채택된 국제채권양도협약은 채권양도와 관련한 원칙을 수립하고 이와 관련한 규정을 제정하였다. 협약은 특정한 법규상 또는 계약상의 제약과 같은 법적 장애를 제거하면서 실체법과 국제사법규칙을 명확히 하고자 한다. 본 논문에서는 협약의 적용범위에 대하여 살펴본다. 본 논문에서는 협약의 적용범위를 다음과 같은 다섯 분야로 나누어 분석하였다. (1) 실체적 적용범위 (2) 지역적 적용범위 (3) 적용배제 및 제한 (4) 독립적인 국제사법 규정의 적용범위 (5) 부속서상 실체법 우선 원칙의 적용범위 협약은 팩토링, 수출장기연불어음의 매입금융, 증권화, 재금융, 프로젝트 파이낸스 분야 등에 많은 분야에 적용될 것이다. 원칙적으로 협약은 국제적 채권양도와 국제채권의 양도에 한해서만 적용된다. 그러나 예외적인 경우에는 국내채권의 국내양도에 영향을 주기도 한다.
