Abstract
FTAs recently became new paradigms in international economic law. An increasing number of countries are signing FTAs amongst themselves. Korea also recognised the importance of FTAs in the late 1990s. The government has been carrying out several ambitious FTA policies since then. Korea and the EU launched negotiations of a bilateral FTA in 2007 and they concluded the historic FTA in 2009. Through the FTA, governments and corporations will create for themselves a powerful tool with which to overcome the global economic crisis. Some experts and attempts have suggested to harmonise international competition regulations by FTAs. According to these opinions, FTAs can be a useful short-cut to the establishment of the goal. Meanwhile, many FTAs have provisions on several kinds of competition issues. This paper provides an overview of the interface between FTAs and competition law. It also analyses several FTA provisions dealing with competition issues such as the Korea-Singapore FTA and the EU-Mexico FTA. Focusing on the Korea-EU FTA, the paper analyses the articles regarding competition issues in the FTA and the Agreement concerning cooperation on anti-competitive activities between them. The bilateral agreement provides the detailed regulations on the competition issues between the parties. Furthermore, the paper introduces the possible issues regarding the Korea-EU FTA and proposes some directions to improve the Korean national competition law for the goal.
