【Abstract】 Korea's Competition Law and Policy: Retrospect and Prospect Rhee, Moon Ji The enactment of Korea's competition law in 1980 was a manifestation of the Korean government's desire to have the private sector play the lead, instead of the government, in the operation of the economy. One of the most serious problems, which Korea's competition policy is currently confronted with, is arguably the "excessively broad" regulatory power of the KFTC. The KFTC exercises its regulatory authority to achieve multiple goals in addition to promoting economic efficiency and consumer welfare. Controlling economic concentration has goal of chaebol oversigt which is unique to Korea (and possibly Japan) and may illustrate typical example of ex ante governmental interventions. The pursuit of broader social and political goals by the KFTC may lead to an inefficient allocation of resources, which would undermine the very purpose of competition policy. As Korea's economic circumstances change and globalization of domestic market accelerates, Korea's competition law and policy should be reformed to rise to the new challenges.
