한-EU FTA의 상계관세규정 분석

Abstract

We analyze the Korea-EU FTA's countervailing duties provisions in comparison with the WTO Anti-Dumping Agreement and the EU anti-dumping regulations. First, we analyze the FTA provisions concerning the countervailing duty investigation procedures. The provisions are the obligation to disclose all essential facts and considerations for the provisional measures and the final determination, granting the interested parties the opportunity to express their views, and the obligation to notify the other Party of the receipt of the application for anti-dumping investigation. Second, we analyze the FTA provisions which could be applied in making the countervailing duty determinations. The provisions include public interest, cumulative assessment, and lesser duty rule. Next, we analyze the remaining provisions such as the dispute settlement, the working group on trade remedy co-operation, and harmonization with competition policies. Finally, we suggest issues to be explored, including the methodology to determine injury-margin and the procedures for applying the public interest.
