지역금융기관의 제도개선에 관한 법적 고찰-새마을금고를 중심으로-

본 연구는 새마을금고에 대한 관리･감독체계를 강화하는 한편, 새마을금고를 이용하는 회원의 권리보장 강화를 위한 개선방안을 제시하는데 목적이 있다. 최근 지역 새마을금고 임원의 도덕적 해이와 부실경영으로 인해 관리･감독체계의 강화와 경영구조를 개선해야 한다는 필요성이 끊이지 않고 제기된다. 이에 개선방안을 위하여 입법론적 관점에서 분석하였으며, 개선방안은 다음과 같다. 첫째, 임원의 사익추구를 방지할 수 있는 법･제도적 장치의 구축 둘째, 각종 사건사고에 따른 관리･감독시스템의 강화 셋째, 새마을금고의 경영구조를 개선하는 일환으로써 회원의 참여를 활성화하고 권리보장을 확보하기 위한 법률상 정함이 있어야 할 것이다. 따라서 향후 새마을금고가 사회적 책임을 충실히 수행하며, 우리나라를 대표하는 ‘리딩 금융협동조합’으로 발전해 가길 기대한다.
Abstract
The purpose of this study is to strengthen the management and supervision system for KFCC (MG Saemaul Geumgo), and to suggest improvement measures to reinforce the guarantee of the rights of members who use it. Recently, due to the moral hazard and poor management of local MG Saemaul Geumgo executives, the need to strengthen the management and supervision system and improve the management structure is constantly being raised. Therefore, the improvement plan was analyzed from the legislative point of view, and the improvement plans are as follows. First, the establishment of legal and institutional mechanisms to prevent executives from pursuing private interests, Second, strengthening the management and supervision system according to various incidents and accidents, Third, as part of improving the management structure of the MG Saemaul Geumgo, there should be legal provisions for activating member participation and securing rights. Therefore, it is expected that MG Saemaul Geumgo will faithfully fulfill its social responsibilities in the future and develop into a “Leading Financial Cooperative” representing Korea.
