Abstract
This article has examined how to assess the limitation on judicial review of legislation and how to interpret such limitations. Even though judicial review of legislation is prevalent around the world today, Netherlands prohibit it, Turkey has certain temporal limitation on judicial review of legislation, Hungary partially restricts the criteria for judicial review of legislation under some economic conditions, and U.K.’s judicial review does not have the effect of invalidating the statutes or prohibiting those from being applied to the original case. In our experience, Yushin Constitution also excluded the Presidential Emergency Measure(hereinafter referred to as “PEM”) from judicial review. The limitation on judicial review of legislation is an exception to the universal form of current constitutionalism that seeks constitutional supremacy, which can contribute to protecting people's freedom and rights to a higher level. Accordingly, it needs to be interpreted limitedly. Limited Interpretation of Limitation is needed. In particular, if the limitation is not a result of a reflection on the Adverse effect of judicial review or an alternative practice based on democratic principles, but rather a result of an intention to reduce the constraint on an arbitrary rule of power, there is a still greater need for limited interpretation. As Constitutional Court is in a firm position that constitutional provisions cannot be nullified, Article 53 (4) of Yushin Constitution should not be deemed null and it is reasonable to make limited interpretation of this limitations. Accordingly, the limitation on judicial review of PEM should be only for the measures that satisfy the requirements of Article 53 (1). Otherwise, even if the requirements are not met, those measures could be free from judicial review of just for a reason that they were proclaimed in the name of PEM. It is contrary to the modern constitutionalism. Therefore, in spite of Article 53 (4) of the Yushin Constitution, it is possible to constitutionally review whether PEMs satisfy the requirements of Article 53 (1). In the light of the Constitutional Court's decision that PEMs No. 1 and No. 9 don’t meet the constitutional requirements for issuance, those measures can be declared unconstitutional, even if constitutional review of PEMs should be based on the Yushin Constitution. Furthermore, by applying this interpretation to the other examples of foreign countries in this paper, we examined how this interpretation can be used in constitutional practice concretely.
