이혼율의 증가 등으로 한부모가정이 늘어남에 따라 양육비의 안정적인 확보가 무엇보다 중요하지만, 종래 양육비 이행확보제도는 일반 민사채무에 대한 강제집행 절차를 따르도록 하여 그 실효성이 낮았다고 할 수 있다. 이러한 양육비 이행확보제도의 개선 필요성에 대한 그동안의 연구와 입법활동에 힙입어 2009년 민법 및 가사소송법의 개정을 통하여 보다 실효성있는 양육비 이행확보제도가 마련되어 시행되고 있다. 이 중 특히 양육비 직접지급명령제도는 장래 채권인 양육비채권에 대한 강제집행을 할 수 있도록 하여 소액 정기금채권인 양육비채권을 실효적으로 확보할 수 있는 제도로서 큰 의미를 가진다. 따라서 이 글은 양육비 직접지급명령제도의 입법과정과 그 요건 및 절차, 그리고 직접지급명령제도가 가장 보편적인 양육비 확보제도로 활용되고 있는 미국의 급여공제제도에 대한 연구를 주된 내용으로 한다. 나아가 양육비 이행확보제도의 발전방향과 관련하여 개선되어야 할 문제점에 대해서도 검토하였다.
Abstract
This paper examines issues surrounding Child Support Enforcement Program. Recently in Koera, increase of a divorce rate and single-parent families have taken a growing interest in introduction Child Support Enforcement Program. In 2008, Family Litigation Act is amended, including establishment of Income Withholding Oder, Child Support Enforcement Program is improved. Income Withholding is the most efficient and available system in the Child Support Enforcement Program. Income Withholding Oder is that the wages of a non-custody parent must be subject to withholding on the effective date of the oder issued in the family court. In case a debtor(non-custodial parent) has failed to pay child support by up to two installments thereof, obligee(custodial parents) can apply for oder of Income Withholding, Notice of Income Withholding from family court are sent to the employee, the employer deducts the specified amount of child support each pay period and sends it to the custodial parent. From now, I expect that Income Withholding Oder gives the child a more stable supply of child support, In addition, child support should tale priority over the other obligation, and there is need for establishment of appropriate standard of child support.
