Abstract
By a subject of international law, I mean an entity that bears international legal rights and duties. Subject of international law is also known as international legal person. Traditionally, it used to be that States were the only recognized subjects of international law. The subjects of international law, however, have been broadened to include non-State actors including international organizations, that is intergovernmental organizations(IGOs), and individuals. Nowadays, It is widely admitted that IGOs have international legal personality. But, the basis of the international legal personality of the IGOs is debatable. Traditionally, the will theory or theory of derivative personality has gained dominant position. According to this theory, the international legal personality of IGOs is conferred on them through or based on the constitutive treaty concluded by member States. But, recently, a radically different theory, that is, theory of ‘objective personality’ has been formulated. Each and every IGO, on this view, would possess international legal personality, provided it wood meet the threshold of ‘organizationhood.’ Relating to the powers of the IGOs, firstly, a theory of ‘attributed or conferred powers’ had been formulated. Accordingly, the IGOs have the powers or competence with which their members endow them. Secondly, it has been argued that the IGOs must be deemed to have those powers which, though not expressly provided in the constitutive treaty, are conferred on them by necessary implication. It is called the principle of ‘implied powers.’ But, recently, some writers have proposed a third source of powers. the IGOs, on this view, once established, would possess ‘inherent powers’ to perform all those acts which they need to perform to attain their aims regardless of attribution or necessary implication. In relation with the theory of objective personality and inherent powers, some issues remain to be reviewed: how the international community may vest the international organizations with the objective international legal personality and inherent powers; whether the IGOs have an objective personality that is binding even on non-members.
