우리나라 장애인활동지원제도의 개선방안에 관한 연구

장애인활동지원제도란 신체적･정신적 장애로 인하여 일상적인 생활을 하는데 어려움을 겪는 중증장애인을 대상으로 활동지원급여를 제공함으로써 장애인의 자립생활, 사회참여, 인권을 증진시키는 장애복지서비스를 말한다. 이 제도는 장애인의 탈시설화 정책과 맞물려 장애인의 자립생활을 지원한다는 점에서 세계적으로 크게 각광받고 있고 폭넓게 이용되고 있다. 우리나라에서도 2011년부터 ‘장애인활동 지원에 관한 법률’에 근거하여 장애인활동지원서비스가 제공되어 왔는데, 2019년 7월부터 장애인등급제가 폐지되고, 지금까지 장애인활동지원급여의 수급자격과 급여량을 결정해 온 ‘인정조사’가 ‘서비스 지원 종합조사’로 대체하게 됨으로써 이 제도의 큰 변화가 예상된다. 본고에서는 이 제도의 문제점으로서 활동지원급여 신청제한의 문제, 이용자들의 선택권 제한의 문제, 그리고 제도의 운영과 관련하여, 활동지원인력의 열악한 처우의 문제, 활동지원인력 성별･연령별 차이의 문제, 부정수급의 문제 등을 들면서, 다음과 같은 개선방안을 제시하고 있다. 첫째, 장애인등급제의 폐지로 활동지원급여 신청 제한의 문제는 어느 정도 해소되었지만, 활동지원인력의 확보와 함께 본인부담금비율을 최대한 낮추어 실질적으로 신청이 제한되지 않도록 해야 한다. 둘째, 장애인들의 선택권 제한의 문제를 해결하기 위해서는 활동지원인력을 늘려야 하는 바, 이를 위하여 지원예산을 증액하여 활동지원인력의 처우개선과 근로조건을 개선해야 한다. 셋째, 이 제도의 운영과 관련하여 활동지원인력의 열악한 처우의 문제, 활동지원인력 성별･연령별 차이의 문제는 활동지원인력의 처우개선 등 근로조건의 개선으로 해결해야 되고, 부정수급의 문제는 철저한 규제･감독과 함께, 장애인활동지원서비스를 지방자치단체가 직접 운영하거나, 사회서비스지원센터 등 별도의 공공기관을 설립하여 운영함으로써 해결해야 한다. 마지막으로 새로 도입되는 ‘서비스 지원 종합조사’와 관련하여 ①일일지원시간 최대치 자체를 늘려 가급적 급여량을 증가시켜야 하며, ②장애특성별 영역별 배점 및 조사항목의 조정, 사회활동영역에서 일일지원시간 산식의 계수 변경 등을 통하여 장애유형에 따른 급여량의 격차를 줄여야 하고, ③조사항목 선택지간 배점 차이를 조정함으로써 최중증 장애인과 중･경증 장애인 사이에 급여량 격차를 조정해야 한다.
Abstract
The Personal Assistance Service for People with Disabilities is the welfare service for people with disabilities that could enhance the independent life, social participation, and human rights of people with disabilities, by providing the personal assistance benefits to people with severe disabilities experiencing difficulties in daily life due to physical/psychological disabilities. In the aspect of supporting the independent life of people with disabilities in relation to the deinstitutionalization policy for people with disabilities, this system is widely used under the international spotlight. In Korea, based on the ‘Act on the Personal Assistance Service for People with Disabilities’, the Personal Assistance Service has been provided since 2011. However, there are several problems like limited application for personal assistance benefits, limited option for users, and poor treatment of personal assistance manpower, differences of personal assistance manpower in each sex and age, and fraud in relation to the operation of system. In order to solve these problems, this thesis suggests the improvement measures as follows. First, regarding the limited application for personal assistance benefits, the actual application should not be limited by lowering the percentage of user fee to the maximum. Second, to solve the limited option for people with disabilities, the personal assistance manpower should be expanded. Third, the poor treatment of personal assistance manpower and differences in each sex and age should be solved with the improvement of working conditions like the treatment of personal assistance manpower. In case of fraud, on top of thorough regulation and supervision, the local governments should directly operate the Personal Assistance Service, or install/operate a separate public institution such as social service support center. Lastly, in relation to the newly-introduced ‘Service Support General Survey’, the amount of benefits should be increased as much as possible. By reducing the gap of benefit amount in accordance with disability type and also adjusting the differences in score between choices of survey items, the gap of benefit amount between people with profound disabilities and people with severe/mild disabilities should be adjusted.
