우리나라 개인정보보호 법제의 개선방안에 관한 연구

지능정보사회에 있어서 빅데이터의 활용은 거부할 수 없는 트렌드로 자리하고 있다. 그러나 빅데이터의 활용이 활성화되어야 한다는 산업적 측면의 입장과 개인정보의 보호가 선행되어야 한다는 개인적 측면의 입장이 상충하기 때문에 이에 대한 규제에 있어서 딜레마가 존재한다. 그래서 선진국들은 지능정보사회에서 개인정보의 안전한 활용을 위한 법제를 정비하고 있다. 2018년 발효된 EU의 ‘일반 데이터 보호규칙’(GDPR), 2015년 개정된 일본의 ‘개인정보의 보호에 관한 법률’ 등이 대표적이며, 미국도 2014년 이후 지속적으로 연방 입법을 추진하고 있다. 우리나라에서도 2020년 2월에 ‘개인정보보호법’･‘정보통신망 이용촉진 및 정보보호 등에 관한 법률’･‘신용정보의 이용 및 보호에 관한 법률’ 등 이른바 ‘데이터 3법’을 개정하여 동년 8월부터 시행하고 있다. 이 개정법에서는 가명정보･익명정보 개념, 개인정보 활용 및 확대, 개인정보위원회의 위상강화, 마이데이터 산업 등이 도입되었다. 그러나 이러한 개정으로 개인정보의 이용은 활성화될 수 있겠지만, 그에 따른 개인정보의 보호는 이에 따라가지 못한다는 지적과 함께 그 미비점을 보완해야 한다는 주장이 계속되고 있는 실정이다. 본고에서는 이러한 상황을 고려하여, 미국 연방 차원의 개인정보보호 관련 입법에 관한 논의를 살펴보면서 우리나라의 개정 데이터 3법상 문제점을 도출하고 개선방안을 제시하고 있다. 미국은 세계 디지털 통상규범을 만들어나가는 미국의 역할을 고려하면 이러한 미연방의 입법 논의는 우리나라의 개인정보보호 관련 법제를 개선하는데 중요한 시사점을 제공해 줄 수 있을 것이다.
Abstract
In the society of intelligent information, using big data is an irresistible trend. From the industrial perspective, it is required to activate use of big data, whereas from the personal perspective, personal information protection should take precedence over use of big data. Since they are in conflicting positions, there is a dilemma in terms of regulations. Therefore, developed countries improve their legal system for safe use of personal information in the intelligent information society. Cases in points are EU General Data Protection Regulation(GDPR) that came into effect in 2018, and ‘the act on personal information protection’ amended in 2015, in Japan. The US has tried its Federal legalization continuously since 2014. In Korea, Three Data Bills referring to ‘Personal Information Protection Act’, ‘Act on Promotion of Information and Communications Network Utilization and Information Protection’, and ‘Credit Information Use and Protection Act’ were revised in Feb. 2020, and the revised. The revised acts have been enacted since August of the year. They include concepts of pseudonymous information and anonymous information, and use and expansion of personal information, the enhancement of Personal Information Protection Commission’ presence, and MyData business. Although the revision can help to promote personal information use, there are arguments that personal information protection still falls behind and that it is required to improve insufficiency. In consideration of such a circumstance, this study looks into discussions of personal information protection legalization of the US Federal Government, draws the problems of the revised three data acts, and suggests an improvement plan. Given the role of the US that establishes global digital trade norms, the discussions of the US Federal legalization will be able to provide important implications for improving the legal system of personal information protection in Korea.
