Abstract

This article deals with criminal judicial significance of the death-row phenomenon or death-row syndrome. Since there have never been discussed about this issue in Korea, the concept and components of those are explored from foreign cases. The death-row syndrome are the lived experiences and particular set of conditions of individuals who have been sentenced to death. The psychological and mental effects of this result in harsh suffering to death row inmates. The death-row syndrome can be defined when it includes three components. First, a temporal component regards the extended periods between sentencing and execution. Second, a physical component is about the conditions in death row where a condemned prisoner is held. Third, an experiential component relates to the meaning of living under death penalty. Some might argue that death-row syndrome has few or no implications for capital punishment within Korea where there has been no execution since 1998. However, this article concludes the death-row syndrome can be constitutional issue in the country. It is because the possibility of execution of 58 condemned prisoners still remains with the constitutional verdict that the death penalty is not unconstitutional.
