Abstract
Under Article 6(1) of the Korean Constitution, there is little dispute over the direct domestic legal effect of treaties. However, significant scholarly debate persists regarding whether WTO agreements, in particular, have direct effect and can thus be applied directly by domestic courts. Indeed, Korean Supreme Court precedents contain decisions that both affirm and deny such direct effect, indicating the need for more harmonized legal interpretations. Nonetheless, when treaty provisions become contentious in litigation, they should be interpreted in a manner consistently with the treaty’s intent, following the principle of respecting international law. This paper explores the legal and practical challenges involved in applying the Agreement on Implementation of Article 7 of GATT (the “Customs Valuation Agreement”) within Korea’s legal framework, focusing on the fourth method (Deductive Method). In particular, it critically analyzes prior court decisions that found illegality in the selection of comparable firms for calculating “profits and general expenses.” These precedents primarily relied on earlier Customs Service Notices, despite the Customs Valuation Agreement stipulating only that valuations under the fourth method be reasonably based on readily available information. The courts appear to interpret the Customs Service Notices too strictly, and a more flexible reading aligned with the spirit of the Customs Valuation Agreement is warranted. Although the relevant rulings may need improvement, it is anticipated that revising customs legislation to more clearly reflect the objectives of the Customs Valuation Agreement will help reduce judicial errors and enhance coherence in customs valuation practices.
