Abstract
After 2010, DNA Database Law has come to force in Korea. Comparing to the DNA database law of US or British and other country, Korean law have some distinctive features ; first, the categories of crime and criminals(offender & arrestee) databased are restricted to felony like some kinds of violent or sex crime. and second, all analysed samples are abandoned with no exception. third, if offender and arrestee is proved innocent in criminal procedure, the DNA profiles must be deleted in DNA database. so, although there were much of criticism in legislation procedure, DNA database law has been estimated constitutional with the upholding about crime prevention effect of serious recidivism and restricted category databased in relation to the problem of privacy or other human rights. but with progress of analysing technique, for example, Y-STR analyse, the expansion of databased category in DNA database by detouring method, like as familiar search. familiar search is meaned a investigative tools by partial match or near miss case in comparing DNA loci of samples. in this case, offender or arrestee databased takes a pivotal role, so his or her familiar members have been suspicious based by police, law enforcement agency through partial match of DNA type with forensic sample and offender(who is a relative) sample. there are some serious problem of privacy infringement, expecially with a familiar member who has no rational suspicion on crime. and DNA profiling is to be functioned simply as not personal identification method, opening the information about secret and personal familiar affairs like as adoption, divorce, incest, etc. in this paper, focusing on Y-STR & familiar search as criminal investigative tools, I will propose a rational solution related to the infringing traits to privacy in DNA database.
