제4차 산업혁명 시대에 중요성이 강조되고 있는 산업기술을 보호하기 위해 정부는 다양한 정책을 추진하고 있다. 경찰에서도 2010년부터 산업기술유출범죄 전담수사팀을 운영하며 디지털포렌식 교육 등 수사관의 전문성을 강화하고 있지만 산업기술유출범죄의 특성에 적합한 조사기법에 대한 교육이나 연구는 부족했다. 이 연구에서는 A지방경찰청 산업기술유출 전담수사관 7명을 대상으로 질적 인터뷰와 NVivo12 프로그램을 사용해서 분석한 결과를 바탕으로 산업기술유출범죄 피의자의 특징에 적합한 실증적인 조사기법을 도출하고자 했다. 그 결과 진술의 모순점을 추궁하고 수사관이 공정하고 진실하다는 것을 보여주는 것이 가장 효과적인 조사기법이라는 것을 확인했다. 이러한 조사기법은 미국의 리드 기법 보다는 영국의 PEACE 모델과 유사했다. 이 연구결과는 처음 산업기술유출범죄 수사를 시작하는 수사관들에게 가이드라인이 될 뿐만 아니라, 향후 우리나라 실정에 맞는 조사기법 개발과 체계적인 조사기법 교육 확대에도 기여할 것으로 기대한다.
Abstract
In order to protect industrial technology, whose importance is emphasized in the era of the Fourth Industrial Revolution, the government is pursuing various policies. The police have also been strengthening investigators' expertise, including digital forensics education, by operating an investigation team dedicated to industrial espionage crimes since 2010, but there has been a lack of education or research on investigative techniques suitable for the characteristics of industrial espionage crimes. Based on the results of the analysis using qualitative interviews with 7 investigators on industrial espionage crimes and NVivo12 program, the study sought to derive empirical investigation techniques suitable for the characteristics of suspects in industrial espionage crimes. The result confirmed that the most effective investigative technique was to interrogate the inconsistencies in statements and show that the investigator was fair and sincere. This research technique was more similar to the PEACE model in The United Kingdom than the Reid Technique in The United States. It is expected that this research result will not only serve as a guideline for investigators who start investigating industrial espionage crimes for the first time, but also contribute to the development of investigation techniques suitable for the situation in Republic of Korea and the expansion of systematic investigation techniques education.
