UCP 600 제28조의 특징은 문장이 간결화 되고 의미도 더 분명하게 작성되었다는 점이다. 보험서류의 발행자, 보험담보기간, 면책약관의 표기에 관하여 새로운 규정이 UCP 600에 도입되었고, 보험서류, 최저보험금액, 부보범위의 표시, 보험서류의 발행일에 대하여는 조금 수정되었고 나머지 내용은 수정되지 않았다. 보험서류는 보험증권, 보험증명서, 확정통지서만이 유효한 보험서류로 간주되며, 대리권자도 보험서류를 발행할 수 있도록 하였다. 보험담보기간에 관하여 UCP 600의 보험담보 시발점과 종결점은 CIP, CPT가격조건과 ICC(A) 운송약관에 명시된 것과 다르지만 UCP 600의 규정은 최소담보기간을 의미하기 때문에 보험서류에 기재된 보험담보의 시발점과 종결점이 UCP 600의 보험담보의 시발점과 종결점을 포함하면 은행은 보험서류를 수리하여야 한다.
Abstract
The practices of the commercial parties has been standardized by the International Chamber of Commerce by publishing the Uniform Customs and Practice for Documentary in 1933 and subsequently updating it. The UCP for Documentary Credit is a set of the rules on the issuance and letters of credit. Documentary Letter of Credit is the main method of payment in international trade transaction. The UCP is utilized by banks and commercial parties in more than 175 countries. Some 11-15% of international trade utilizes letter of credit, totaling more than a trillion dollars(us) per annum. The ICC has developed and moulded the UCP by regular revisions. The revision commenced in May 2003. The stated aim of the new revision has been, as with earlier revisions, “to address development in the banking, transport and insurance industries". The aim of ICC was to enhance the reputation of letters of credit as the settlement means of choice among international traders. Part of this aim involves reducing documentary rejections, which surveys indicate may be as 70% of first presentations. The latest revision was approved by the Banking Commission of the ICC at its meeting in Paris on October 24, 2006. These new became effective July 1, 2007. UCP 600 came at time when use is on the decease world wide due to high changes of L/C associated with divergent interpretation causing payment risk. Language of UCP 600 article 28 has been made more clear and simple. For the insurance documents the following has been changed. Proxies can now sign on behalf of the insurance company or underwriter. Percentage to be covered will be understand as a minium coverage required. The document may contain reference to any exclusion clause. The risks must be covered at least the shipment points stipulated in the credit.
