개정 화환신용장통일규칙(UCP 600)상 운송서류의 수리요건과 문제점에 관한 연구

UCP 600 운송서류 수리요건의 특징적 측면은 복합운송서류와 선하증권의 영문명칭 변경, 용선계약 선하증권의 서명자에 용선자와 그 대리인의 추가 및 용선자에게 양륙항구 선택권의 부여, 운송방식별 환적개념의 명료화, 철도운송서류에서 철도회사의 서명이나 날인의 인정 및 부본의 수리, 송하인이나 화주용 원본이나 누구를 위한 것인지 표시가 없는 도로운송서류의 수리, 철도운송서류와 내륙운송서류의 원본표시가 없어도 수리가 가능한 것으로 요약할 수 있다. 이러한 특징에도 불구하고 UCP 600 운송조항은 복합운송서류의 운송인의 범위가 누락되고 영문표기가 국제규칙이나 운송실무와 불일치하는 점, 운송주선인 발행 일부서류의 수리요건의 미비, 선하증권과 비유통성 해상화물운송장의 조문내용이 동일함에도 조항을 통합하지 않은 점, 도로운송서류철도운송서류내륙수로운송서류를 동일한 조항에 통합하여 혼란을 유발한 점, 복합운송서류와 항공운송서류의 환적개념이 현실관행과 불일치한 점, 일부 운송서류의 운송인에게 환적권한 유보에 대한 명확한 규정이 없는 점 등의 문제점이 있으므로 보완해야 한다.
Abstract
The acceptance requirements of transport documents under UCP 600 can be summarized as follows; change in titles of transport document covering at least two different modes of transport and bill of lading, in charter party bill of lading adding to charterer or named agent as a signer and giving freedom to charterer the right to optional port of discharge, clarification regarding transshipment according to mode of transport, signature or stamp of railway company and marked duplicate will be accepted in rail transport document, appearing to be the original for consignor of shipper or not indicate for whom it was prepared in road transport document. Notwithstanding this characteristics, transport document clauses have the following problems; such as omitting of scope of carrier and discrepancy in title of multimodal transport document international rules and practices, lack of acceptance of some freight forwarder's transport documents, same to content in clause of bill of lading and non-negotiable sea waybill, remaining as one article of road․railway or inland waterway transport documents, transshipment definition in discrepant with transport practices of multimodal transport and air transport, lack of the clause on reserving the right to transship to carrier of some transport documents.
