형사조정을 통한 가해자와 피해자의 관계 회복에 대한 경험적 연구

본 연구는 형사조정을 통한 가해자와 피해자 간의 관계 회복의 실태와 요인에 대한 경험적 고찰을 목적으로 한다. 연구에 활용된 자료는 2008～2009년(522명)과 2015년(770명)에 조정회의에 참여한 가해자와 피해자를 대상으로 실시한 설문조사 자료이다. 자료 분석을 통하여 발견된 사실을 요약하면 다음과 같다. 첫째, 형사조정을 통한 가해자와 피해자 간의 관계 회복 정도는 형사조정제도 시행 초기인 2008～2009년에 비해서 2015년에 하락한 것으로 나타났다. 5점 만점 기준으로 3.75에서 3.55로 낮아졌다. 둘째, 가해자보다는 피해자, 남자보다는 여자의 관계 회복의 정도가 더 낮은 것으로 나타났다. 연령이 낮을수록, 가해자와 피해자가 가까운 사이일수록 관계 회복의 정도가 낮은 것으로 나타났다. 셋째, 관계 회복에 유의미한 영향을 미치는 요인은 ‘갈등해소와 관계 회복을 중요시하는 조정위원의 태도’, ‘가해자와 피해자의 이야기를 진지하게 경청’, ‘가해자와 피해자가 자신의 입장을 충분하게 설명’, ‘조정회의 참여의 자율적 결정’, ‘조정회의 시간의 충분한 확보‘인 것으로 나타났다.
Abstract
This study purposes to figure out effect and factors of restoration of relationship between offender and victim through victim-offender mediation(VOM) program. The data used for this study is acquired through survey conducted on offenders and victims who attended the mediation meeting in 2008～2009(552 cases) and 2015(770 cases). The main findings from data analysis can be summarized as follows. First, the restoration level of relationship between offender and victim through mediation meeting is appeared to be dropped in 2015 compared to 2008～2009. In five-point scale basis, it got lowered from 3.75 to 3.55. Second, the analysis result showed that the restoration level of relationship of victims than offenders, and women than men are lower. Also, the restoration level was lower when age was younger, and the relationship between offender and victim were close. Third, the significant factors on restoration of relationship were appeared to be ‘attitude of mediators who put importance in conflict resolution between offender and victim’, ‘courteous listening to remarks of offender and victim’, ‘sufficient explanation of position of offender and victim’, ‘autonomous decision of the mediation meeting participation’, and ‘securing sufficient meeting time’.
