본 연구는 스칸디나비아의 3개 국가를 대상으로 다문화 법적 체계와 통합정책을 비교하였다. 비교기준은 Borevi(2010)가 제시한 다문화 통합정책을 4개로 유형화한 틀이다. Borevi(2010)는 소수민족의 정체성과 국가 정체성에 따라 다문화정책의 성격을 민족 융화, 시민 통합, 민족분리, 다문화주로 분류하였다. 스칸디나비아 3개국인 덴마크, 노르웨이. 스웨덴의 법적체계와 통합정책을 분석하여 각 국가가 Borevi(2010)의 유형화에서 어느 군에 속하는지를 탐색하였다. 결론적으로 덴마크는 이주민 융화의 모습으로, 노르웨이는 융화정책과 통합 사이였으며, 스웨덴은 통합의 양상에 가까웠다. 법적 체계를 살펴보면 덴마크와 노르웨이는 스웨덴 보다 유사했는데 이들은 도입법과 외국인법(이주민법)을 제정하여 좀 더 이주민의 권리와 의무의 규정를 강조하였다. 그러나 스웨덴은 헌법, 노동이민법, 반차별법, 교육법 등을 다양한 법적 체계를 통해 이주민의 의무보다 권리를 강조하고 있었다. 법체계내의 사회정책을 분석해본 결과 스칸디나비아 이주민 정책의 유사점은 고용 중심, 지방자치단체의 책임 강화였다. 특히 스칸디나비아 국가들은 이주민의 문화적응의 핵심요소로 고용을 제 1차적인 우선순위로 두고 있었다. 또한 전달체계 측면에서 지방자치단체를 거점으로 하여 다양한 기관이 협력해야 한다는 것을 명시하고 있었다. 차이점으로는 덴마크의 정책이 우경화 방향으로 흐르면서 덴마크의 가치와 규범을 이주민이 따를 것을 강조하고 있었다. 스웨덴의 경우 이주민의 차별 방지를 위해 옴브즈만이나 통역서비스, 다문화 센터 등을 통해 다각적 측면으로 지원이 이루어지고 있었다. 노르웨이는 여기의 중간 이었다.
Abstract
This study compares multicultural legal system and integration policy for Scandinavian countries. The comparison criterion borrowed from nationalism, national separation, civic integration and multiculturalism according to Borevi's (2010) general recognition of national identity and the active development of ethnic identity. In conclusion, comparing the legal system and policy, Denmark is a form of assimilation, Norway is between assimilation and integration, and Sweden is close to integration. In terms of the legal system, Denmark and Norway were more similar than Sweden, and they introduced the introduction law and the foreigner's law (immigration law), emphasizing more the rights and obligations of migrants. Analysis of the social policy in the legal system shows that the similarity of the Scandinavian migrants' policy is to strengthen the responsibility of the employment-oriented and local governments. In particular, Scandinavian countries had employment as a primary priority as a key element of migrant cultural adaptation. It also stated that various agencies should cooperate with local governments in terms of delivery system. The difference is that as the policy of Denmark moves towards the right direction, it emphasizes that the immigrants should follow the values and norms of Danish. In Sweden, multicultural support was provided through Ombudsman, interpreter services, and multicultural centers in order to prevent discrimination against migrants. Norway was in the middle of here.
