중국의 취업허가제도와 노동법 상의 북한이주노동자

초록

최근 남북정상회담을 필두로 북한 김정은의 세계무대의 진출은 북한 내의 핵문제 해결 외에도 UN의 대북제재의 해제나 완화로 이어질지 여부에 대한 관심을 증폭시켜왔다. 그러나 UN을 비롯한 미국, 중국 등의 공식적인 대북제재 해제 또는 완화와 관련한 결의나 발표는 없었다. 하지만, 2018년 북-중간 정상회담 이후인 3월말부터 중국은 북한이주노동자의 입국을 암묵적으로 허용하고 있는 것으로 보여, 북한이주노동자와 관련한 노동인권문제는 여전히 이슈일 수밖에 없다. 그런데, 기존에 제기되었던 북한의 인력송출 과정에서의 노동인권보장과 관련한 여러 비판에도 불구하고, 북한에 대한 UN 제재결의 및 인권결의를 포함한 미국이나 우리나라의 북한인권보호관련 법제에는 북한이주노동자에 대한 사용국 및 사용자의 법적 책임방안이 포함되어 있지 않다. 이에, 이 연구에서는 북한이주노동자의 노동인권보장을 위해 우선적으로 요구되는 인력도입국의 책임과 노동법상 사용자 책임의 기본원칙을 강조한다. 그러면서, 먼저 북한이주노동자의 노동인권실태를 중국을 중심으로 살펴보고, 중국의 취업허가제 및 노동법제를 검토하여, 향후 북한이주노동자에 대한 국제적인 대응방안을 모색해 보고자 한다.

Abstract

Since the recent inter-Korean summit and North Korean leader Kim Jong-un's entrance on the world stage in 2018, interest has increased as to whether international sanctions against North Korea will be lifted or relaxed, in addition to the chances of resolving the nuclear issue on the Korean peninsula. However, no resolutions or official announcements have been made stating that UN sanctions or official US sanctions will be lifted, or regarding Chinese relaxation of enforcement of UN sanctions. Nevertheless, from the end of March 2018, after the Sino-DPRK summit, reports surfaced that China is implicitly allowing North Korean migrant workers to enter the country. Therefore, the labor rights of North Korean migrant workers remain an issue. Regarding North Korean human rights, criticisms have been raised which typically point to labor issues surrounding North Korea’s sending of workers abroad. But despite these criticisms, the US and South Korean legislation related to the protection of North Korean human rights, and the UN human rights and sanctions resolutions with regard to North Korea, the employers’ legal responsibility in the case of North Korean migrant workers is not adequately discussed. To address this gap, this study emphasizes the basic principles of employer liability in labor law in relation to guaranteeing the labor rights of North Korean migrant workers. Accordingly, we examine the situation of labor rights of North Korean migrant workers in China, as well as China's work permit system and labor laws as they pertain to foreign workers and who takes responsibility for those workers. Finally, we provide recommendations for the international community on how to respond to the situation of North Korean migrant workers.
