2011년 6월 ILO(국제노동기구)는 제189호 「가사노동자 협약」 채택하였고, 우리나라에서도 2012년 ‘협약 비준동의안 제출 촉구 결의안’이 가결되었다. 그 후 2021년 6월 15일 「가사근로자법」을 제정･시행하였다. 이로써 가사서비스 제공기관과 근로계약을 체결한 가사근로자는 최저임금, 사회보험, 퇴직금, 연차유급휴가 등 노동법상 권리를 일부 보장받게 되었다. 이는 「근로기준법」을 제정(1953년)한지 70년 만에 가사노동자도 제한적이나마 노동법을 적용받게 된 점에서 의의가 크다. 그럼에도 여전히 가사노동시장은 비공식 영역에 머물러 있고, 가사노동자의 대부분은 50대 이상 고령자이자 여성이며, 노동환경의 개선사항 중에서도 노동 강도에 비해 낮은 임금수준, 건강문제 등이 최대 쟁점이 되고 있다. 특히, 가사노동자의 노동은 상당한 감정노동과 강도 높은 육체노동을 수반하며, 고객과의 관계에서 괴롭힘(갑질) 등 인권 침해에 상시 노출되고 있다. 이에 가사노동자의 권익보호를 위해서는 건강권 보호, 그 중에서도 산업안전보건, 감정노동자 보호 및 직장내 괴롭힘 등과 관련한 논의가 필요하며, 예방에서 사후 조치까지 관련된 지원책 마련이 절실한 상황이다. 본고에서는 2023년 서울특별시 가사노동자를 중심으로 실시된 “서울시 가사노동자 노동환경 실태조사”에 기초해 서울시 가사노동자의 휴식권 및 건강권 관련 의미와 쟁점을 확인하고, 가사노동자의 고용안정 및 근로조건 향상에 기여할 수 있도록 정책 과제를 제안하고자 한다.
Abstract
In June 2011, the International Labor Organization (ILO) adopted Convention No. 189, the Convention Concerning Decent Work for Domestic Workers. In Korea, the ‘Resolution urging the submission of a motion to ratify the Convention’ was passed in 2012, and the ‘Domestic Workers Act’ was enacted and implemented on June 15, 2021. As a result, domestic workers who have signed a labor contract with a domestic service provider can be guaranteed some of their rights under labor law, such as minimum wage, social insurance, severance pay, and annual paid leave. This means that 70 years after the enactment of the Labor Standards Act (1953), domestic workers have also been subject to the labor law, albeit in a limited way, and this has great significance in terms of labor law. Nevertheless, the domestic labor market still remains in the informal sector, and the majority of domestic workers are women and elderly people in their 50s or older. Despite the measures to improve the working environment of domestic workers, low wages compared to labor intensity and health problems are still common and significant issues. In particular, the work of domestic workers involves considerable emotional labor and intense physical labor, and they are constantly exposed to human rights violations, such as harassment (abuse of power) in relationships with customers. Accordingly, in order to protect the rights and interests of domestic workers, such issues cannot be excluded from discussions related to the protection of domestic workers' health rights, especially occupational safety and health, protection of emotional workers, and workplace harassment, and there is a great need to prepare related support measures from prevention to follow-up measures. Based on the <Survey on the Working Environment of Domestic Workers in Seoul> conducted in 2023 focusing on domestic workers in Seoul, in this article we identify the meaning and issues related to the right to health and rest for these workers, and discuss how to improve employment stability and working conditions for domestic workers. We also propose policy tasks that could contribute to needed improvements.
