Abstract
We have opened the way to political democracy through the June 29th Declaration from 1987. But we have many challenging factors for political democracy such as remnant of long confucian tradition and authoritarian ruling. It is useful for us to follow up American experience for free expression. In U.S.A. there have been many trials to expand public forums for the freedom of expression and press. So they have many cases for free expression according to the tradition of the First Amendment and case law. For the expression and the press it is the most important thing where to speak and to report. The Supreme Court have formed the public Forum Doctrine that it is necessary for states to control the regulation state properties i.e. places and space for freedom of expression and press. This study on the public forum is for the purpose to expose the marketplace of ideas to the real world and to expand the marketplace. The marketplace of ideas is approaching more heartly to us who live in modern society. Through this we should realize the 4 values of self-fulfillment, attainment of truth, participation in policy making, balance between the stability and change which T. Emerson categorized from the First Amendment. There have been many changes in the public forum from the traditional public forum i.e. streets and parks to broadcast media and SNS etc.. The Public Forum Doctrine has been focused on securing punctually the freedom of expression and press by the First Amendment. Through this study we can find out easily the conflicts about the Public Forum Doctrine are lasting even in U.S.A. where liberal democracy is full blown. It has been constructed from the case where one community had issued narrowly the license to access the public forum for keeping peace in that city. It is the key point for long debatings that the public forum as the marketplace for ideas is the core place for the freedom of expression and press. At the last the public forum doctrine will be developed by the cases about the assembly and demonstration and legislation of government and municipality in Korea. The public forum doctrine will be more developed dialectically with Habermas’ public sphere theory. Through these courses the freedom of expression and press will be expanded loudly, and we have to find out the way to develop Habermas’ constitutional patriotism which is the key center for social solidarity and liberal democracy.
