슈뢰더(Gehard Schröder) 수상은 노동시장과 사회보장제도를 개혁하여 독일 경제의 경쟁력을 회복하고자 하였다. 미니잡 활성화를 통해 근로자가 부담하는 사회보험료와 세금 부담을 줄여 취업할 경제적 유인을 높이고, 사용자에게 노동시장의 유연성을 높여 신규 채용을 확대하도록 유인하며, 일반근로자와 동일한 노동법상의 보호를 제공하면서 실업을 줄이려 하였다. 독일에서는 노동법을 통하여 미니잡 근로자에게 일반근로자와 동일한 대우, 해고 보호 및 휴가 규정을 적용한다. 또한 일반근로자와 동일한 내용의 국민연금제도와 산재보험제도를 적용하여 취약계층에 대한 보호를 강화하며, 임금계속지급, 산전후휴가급여 및 도산수당 규정을 적용함으로써 사회적 취약계층인 미니잡 근로자를 보호한다. 본 논문에서 미니잡 취업자의 범위를 법률 규정을 통하여 상세히 설명한 후 미니잡 근로자 보호 내용을 살펴보고 시사점을 도출하였다.
Abstract
German chancellor Schröder intended to recover competitiveness of German economy by reforming the labor market and social security system. Through vitalizing minijob activity, he desired to provide employees with economic incentive for work by reducing the burden of social insurance and tax, and to decrease unemployment while providing the same protection stated by the labor act as the normal worker. Germany applies the same treatment to minijob employees as the normal worker, in accordance with the labor act, providing protection of dismissal and vacation policy. The protection of minijob employee is reinforced by applying the same regulation of National Pension Scheme, Workers’ Compensation Insurance, and other social protection measures as the normal worker. The purpose of this paper is to find out implications for Korea by analyzing the range and social protection of minijob employee.
