베트남의 행정개혁 법제 연구: 헌법, 행정쟁송법 및 부패방지법제를 중심으로

베트남은 체제전환 이후 행정개혁을 수행해 왔으나 눈에 띄는 성과는 없으며 행정법제도2000년대 이래 세분화된 입법 및 개정을 수행하고 있으나, 이러한 법제 개편이 실제 충실히 집행되고 있는지는 여전히 의문스럽다. 하지만, 인민의 권리 및 법익 침해 구제에 중점을 두는 법제가 도입되고 있는 것을 볼 때 행정의 개혁, 합리화 및 권익 구제라는 정책과제를 놓고 지속적으로 법제를 개선해 오고 있는 것은 사실로 보인다. 구체적으로 본 연구는 2000년대 후반 베트남의 행정법제의 개혁을 배경으로 도입된 행정소송법, 이의신청법과 공익침해행위 신고법의 분화를 살펴보았다. 또, 반부패법을 위시한 다양한형태의 부패방지법제를 개괄해 보았다. 성장 잠재력이 높은 베트남 경제가 향후 지속적으로발전하고 더 다양한 인민의 권익 보호 요구가 표출되면서 행정절차법 및 부패방지법제의 추가적인 제⋅개정이 이루어질 것으로 예상된다. 꾸준한 모니터링을 통한 자료와 연구의 축적은 향후법제 지원 및 대북 협력에 효과적인 자료가 될 것이다
Abstract
In Vietnam, administrative reform has been conducted after its reformation of regime; nonetheless, no conspicuous result has been reported so far. Vietnamese legislative body has been elaborating and amending its Administrative Law since the 2000s. However, it is questionable whether the legislative reorganization is really being enforced in practice. Nevertheless, given the introduction of public law for the rectification of human rights abuse and violation of law, it deems reasonable that Vietnam has been continuously reforming its legislation pursuant to the policy agenda, which is administrative reform and streamlining, and protection of human rights. The thesis reviews the Vietnamese Administrative Procedure Law, and Vietnamese Law on Complaints & Denunciation, introduced during the era of administrative reform. Moreover, various forms of Vietnamese anti-corruption laws were also examined. It is highly anticipated that more various legal reforms for protection of human rights in the area of administrative law will come up with the Vietnamese continuous economic development. Accumulating related information through constant monitoring would be beneficial for legal co-operation between Korea and Vietnam, which will ultimately lead to favorable co-operation between two Koreas, South and North which is likely to pursue a path of open policy similar to Vietnam.
