대북 경제제재 국면에서의 공동어로구역 추진방안

2007년 남북관계 발전과 평화번영을 위한 선언(10.4 공동선언)에서 제시된 서해평화협력특별지대 설치의 세부사업으로 제시된 공동어로구역의 설정 구상안은 서해안보가 현안인 남측과수산자원 확보가 절실한 북한 모두에게 매력적인 사업이자, 남북한 간에 협의해 온 평화수역의실질적 이용에 부합하는 사업이다. 공동어로구역의 설정은 남한과 북한의 수역을 남북한 어업인이 공동으로 이용하여 중국 어선의 불법조업을 방지하는 실용성과 함께, 남북한 간 수한협력의초석을 마련한다는 점에서 남북화해와 협력 그리고 공동번영이라는 상징성을 가지는 사업이다. 다만 공동어로구역 설정 구상도 현 유엔 대북제재에 저촉되지 않는 범위에서 추진되어야 한다. 본 연구는 국제규범인 유엔 대북제재 규범 하에서 서해 공동어로구역 설정 구상의 실현가능성에대한 법규범적 검토를 진행하는 것을 내용으로 한다. 유엔 대북제재는 금지대상품목의 직접적인 공급, 판매, 이전, 수출 등의 행위를 국가가 실행하는 것을 금지하고 있으므로, 공동어로구역설정 및 북한 선박의 공동어로구역에서 어획하는 행위그 자체는 대북제재에 저촉되는 것으로 보기는 어려울 것이다. 유엔 대북제재는 핵개발에 전용될 수 있는 자금이전을 차단하는 것이지, 북한의 조업활동 그 자체를 금지하는 것은 아니기 때문이다. 공동어로구역 설정은 북한의 식량난 해소에 기여할 수 있는 인도적 사업으로 대북제재면제대상이 될 수 있다. 다만 공동어로구역 내에서 북한과의 해산물 교역을 추진하는 사업과유상입어수역 설정 방식의 공동어로구역 설정은 해산물 교역과 조업권 판매를 금지하는 유엔대북제재에 저촉됨을 유의하여야 한다.
Abstract
Drawing a joint fishing zone, one of the detailed projects of the establishment of the Special Zone for Peace Cooperation in the West Sea proposed in the Declaration on the Advancement of South-North Korean Relations, Peace and Prosperity in 2007, has brought about taken attention for the two Koreas. It is because the West Coast is an issue in the South, and the North which both have a stake in fishery resources. However, the initiative should be promoted to the extent that it does not violate the current UN economic sanctions against the DPRK. This study reviews legal issues arising from the joint fishing zone. Current UN economic sanctions completely prohibit seafood trade with the DPRK, and prohibit the sale and transfer of fishing rights of the DPRK as well. Since UN economic sanctions prohibit a state from directly supplying, selling, transferring, and exporting banned items, it is difficult to regard both the joint fishing zone and the DPRK flagged fishing boats' catching in the zone as violating the UN economic sanctions. The joint fishing zone is a humanitarian project which contributes to help tackle the chronic food shortages experienced by the DPRK and can be exempt from the sanctions. However, the project to promote seafood trade with the DPRK within the joint fishing zone and the establishment of a paid fishing area violate UN sanctions, which prohibit seafood trade and the sale of fishing rights.
