일본 후쿠시마 원전 사고 오염수의 해양배출은 자연재해 등의 사고로 인해 발생한 원전 오염수의 해양배출을 용인한 선례로 남게 되었다. 국내에서는 후쿠시마 원전 사고 오염수의 해양투기의 안전성에 대한 의견대립은 국론분열에 이를 정도로 심각한 상황으로 치닫고 있다. 현재 원전 오염수의 해양배출에 대해서는 적용가능한 국제규범이 없는 것으로 판단된다. 원전 폐기물의 해양투기는 금지되고 있으나, 원전 오염수의 법적성격과 처리방식에 대한 규범은 없는 것이다. 이에 원전 오염수의 안정성에 대한 과학적 불확실성의 상황에서 예측불가능한 피해를 방지하기 위해, 원전 오염수의 해양배출을 규율하는 국제규범이 정립이 필요하다는 주장이 제기되고 있다. 국제규범의 정립은 결국 원전을 보유하고 있는 국가들의 국가관행을 토대로 공통의 규범을 도출하는 방식으로 진행될 것으로 예측된다. 이에 본 연구는 국제규범의 정립을 위한 기초연구로써 원자력 방사성폐기물처리에 관한 한국의 국가관행을 분석하였다. 원전 오염수처리에 관한 국내법률, 해양폐기물처리에 관한 국내법률 등을 분석하여 비정상적 환경에서의 원전 오염수의 처리기준을 확인하였다. 동 연구를 통해 원자력안전법의 개정안과 국제규범의 정립에 있어서 고려되어야 할 기준들을 제시함으로써, 우리나라가 관련 국제규범의 정립에 있어서 주도적 역할을 수행하는데 기여하고자 한다.
Abstract
The ocean discharge of contaminated water from the Fukushima nuclear power plant accident in Japan has become a precedent for accepting the ocean discharge of contaminated water from nuclear power plants caused by accidents such as natural disasters. In Korea, conflict of opinion on the safety of discharging contaminated water from the Fukushima nuclear power plant accident to the ocean is reaching a serious situation, reaching the point of division of public opinion. Currently, it is believed that there are no applicable international laws for ocean discharge of contaminated water from nuclear power plants. Although ocean dumping of nuclear power plant waste is prohibited, there are no norms regarding the legal nature and treatment method of contaminated water from nuclear power plants. Accordingly, in order to prevent unpredictable damage in a situation of scientific uncertainty about the stability of nuclear power plant contaminated water, it is argued that international norms governing the ocean discharge of nuclear power plant contaminated water need to be established. It is expected that the establishment of international norms will ultimately proceed by deriving common norms based on the national practices of countries that own nuclear power plants. Accordingly, this study analyzed Korea's national practices regarding nuclear radioactive waste disposal as a basic research to establish international standards. By analyzing domestic laws on the treatment of contaminated water from nuclear power plants and domestic laws on the disposal of marine waste, this study confirmed the standards for treating contaminated water from nuclear power plants in abnormal situations. It also proposed amendments to the Nuclear Safety Act. By presenting standards that should be considered in establishing international norms, this study seeks to contribute to Korea playing a leading role in establishing relevant international norms.
