통상적으로 의료소송에 있어서는 의사와 환자의 입장이 분명히 대립하는 것은 불문가지의 사실이다. 이러한 가운데 이 글은 그동안 필자가 의사의 입장에서 의료소송을 진행하는 과정에서 필요하다고 느낀 점을 법률적 측면에서 정리한 것이다. 즉 의사가 환자를 치료할 때 의료과오를 피하기 위해 많은 주의를 기울인다. 왜냐하면 의사가 의료과오를 범하면 그들은 심각한 민사상․형사상 책임을 부담하기 때문이다. 그러나 의사는 의료수준에 부합한 의료지식을 충분히 터득하고 있을지라도 의료과오를 피하는 방법을 알지 못하여 많은 어려움을 겪는다. 한편 필자가 변호사로서 의사를 위한 의료소송을 진행할 때 가장 어려운 것 중 하나는 진료기록부 기재의 부실 등이다. 이것만 비교적 충실히 되었다고 할지라도 의료과오는 상당부분 효과적으로 의사측에서 극복할 수 있는 훌륭한 무기가 될 수 있다. 따라서 필자는 법적으로 관련법에 따라 진료기록부를 기록할 것을 권유하고자 이 글을 쓴다.
Abstract
When doctors give medical treatments to patients, they pay serious attention to avod medical malpractice. Because if they commit medical malpractice, they have to cover civil and criminal responsibility. But they don`t know the way how to avoid the medical malpractice. When I represented defendants as a lawyer, I have encountered with many difficulties due to the lack of medical records. So I would like to suggest some guidelines for maintaining medical records. I think that doctors only studied the medical science and do not know how to avoid medical malpractice. I would like to advise them to maintain the medical records according to the relevant laws legally, not arbitrarily. For this purpose, this paper is organized as follows.
