민법개정(안)의 여행계약에 관한 고찰

국민소득의 증대와 삶의 질이 향상되면서 여행은 대량소비재로서 관심의 대상이 되면서 여행계약에 관한 법률문제가 빈번히 발생할 가능성이 커졌다. 그런데 우리나라에는 여행계약을 직접 규율하는 실정법이 없어 여행자를 보호하는데 문제가 있다. 여행을 두 가지 유형으로 분류할 때, 여행자가 개인적으로 계획하여 실행하는 개별여행과 여행주최자가 주선하여 다수인이 참여하게 되는 단체여행으로 나누어진다. 법률적으로 문제가 되는 것은 단체여행인데 대부분 여행자와 여행주최자 사이의 계약에 의하여 행하여 진다. 이러한 여행계약과 관련한 법적문제의 해결을 위하여 민법개정(안)에 제 674조의 2~제 674조의 9까지 8개 조문을 신설하고 있다. 그 내용은 독일민법을 참고하여 여행계약의 의의, 여행주최자의 의무, 담보책임, 여행계약의 해제․해지, 대금지급시기 등에 관한 규정을 두고 있는데 이 규정의 내용을 고찰하였다. 또한 입법이 요구되는데도 불구하고 이번에 신설에서 제외된 내용으로서 여행자의 자조권(自助權), 여행자의 교체권과 여행계약규정의 강행규정화의 필요성을 검토하였다. 여행계약(안)의 문제점과 미비점을 수정하고 보완하기 위한 심도있는 논의와 재검토를 통하여 보다 현실생활에 적응할 수 있는 살아있는 민법이 되기를 기대해 본다.
Abstract
According to the development of life quality and income, a travel business is a means of mass consumption in this society, and a problem of travel contract has been occurred for the contraction. In Korea, however, there has been a problem in protecting travellers because they do not provide any direct systems which regulates the positive law for travel contract. In the travel itself, there are two types of system: a personal travel which a person plan and practice the schedule, a package travel which a travel agency presides the schedule for a group of people In most cases of legal conflict, a lot of contract problems are caused between travellers and travel agency in the package travel. So, in order to solve the legal conflict, eight contract clauses are provided in the articles from 674-2 to 674-9 of the proposal of revised civil law. The content of the clauses is derived from the German civil law and it prescribes some regulations such as definition of travel contract, responsibility of travel agency, liability of the travel agency, cancellation or termination of the contract, and period of travel charge. This paper studies the problems mentioned above and examines the quality of legal system in the travel contract. The study also views some issues which was excluded from a new provision of a travel contract though they should be included. The issues that I studied are the content on traveller's right of self-dependence, proposal of provision for traveller's right of replacement, and necessity of compulsory regulations for travel contract. From this study, the problems of travel contract should be revised or supplemented. The profound discussion and review should also be conducted from this study, which would contribute to a real life of travel area based on civil law.
