통학버스 운영 관련 어린이 교통안전 확보방안- 미국의 경험을 참고하여

어린이는 대표적인 우리 사회의 취약계층이라는 점에서 이들에 대한 사회적 관심과 집중은 너무 당연한 것이다. 따라서 어린이와 관련한 안전사고에 대한 규율의 중요성은 아무리 강조해도 지나치지 않다. 특히 어린이 안전사고 규율과 관련하여 집중을 하여야 하는 것은 어린이 통학버스와 관련한 정책이다. 어린이 통학버스 사고는 돌이킬 수 없는 인명피해를 야기한다는 점에서 다른 안전사고와 마찬가지이지만 언급한 바와 같이 어린이 안전사고는 우리 사회 내 대표적 취약계층 중 하나인 어린이에 대한 피해를 야기한다는 점에서 이에 대한 보다 강력한 수준의 정책이 요구된다고 할 수 있다. 물론 어린이의 부족한 인지 능력 및 사고대응 능력 등을 고려하여야 할 것이고 어린이 통학버스와 관련하여 발생하는 사고의 특징 역시 고려하여야 할 것이다. 특히 관련 사고는 여러 가지 요인이 복합적으로 작용하여 발생하고 있는 것이 사실인데 이는 인적 요인과 물적 요인으로 대별하여 제시할 수 있다. 특히 미국의 경우 인적 요인과 물적 요인을 구분하여 보다 엄격한 수준의 규율을 자랑하고 있고 지역별 수준에 따른 규율의 다각화 역시 도모하고 있다는 점에서 단조롭고 형식적인 규율에 머물고 있는 우리에게 미국의 정책은 시사하는 바가 적지 않다. 물론 미국이라고 모든 쟁점 사안에 대한 정답을 가지고 있는 것은 아니지만 객관적인 통계로 사고의 발생을 상당 정도 예방하고 있다는 점에서 의미가 있는 정책은 우리 역시 참고할 만한 가치가 있는 것이다. 우선 미국의 경우를 참고하여 우리도 지역적 수준의 차별적인 규율 방향성을 확보할 필요성이 있다고 생각되기 때문에 지방자치법 상 어린이 통학버스 규율 사무의 특징을 정하여 규율 주체를 보다 명확히 할 필요성이 있다고 생각되며 당해 방안은 조례를 통한 보다 구체적이고 다각적인 규율을 가능하게 할 것이다. 그리고 물적 요인과 인적 요인에 대한 규율 역시 필요하기 때문에 전자의 경우 후방 및 애부 감시 시설과 같은 설비를 장착하도록 유도하여야 할 것이고 후자의 경우에는 관련자의 과실에 대한 관리 및 통제에 더 많은 집중을 하여야 할 것이다. 특히 어린이 통학버스 안전상 확보는 결국 관련자들의 과실에 대한 통제가 주를 이룬다는 점에서 운전자 자격 요건의 강화, 교육 대상자의 확대 그리고 내실 있는 교육 내용 확보 등에 대한 보다 심도 있는 고민이 요구되는 것이 사실이다.
Abstract
It is true that children are vulnerable in our society, social attention and concentration on them are crucial. Therefore, the importance of control and regulation on safety accidents involving children can not be overemphasized. In particular, it is important to secure the policy related to buses for the children’s sake and to concentrate on the discipline on the related to persons such as a bus driver and teacher. As mentioned above, since the safety accidents relating to bus school cause irreversible damage to children seriously, a strong level of policy to regulate the bus school is required. Of course, we are obliged to take in consideration of the fact that the child's cognitive ability and their ability to cope with accidents are too insufficient. Particularly, as it is reasonable to say that school bus - related accidents are commonly caused by a combination of various factors, which can be classified into human factors and material factors, we are forced to consider those factors in order to enhance the level of safety of school bus. Especially, in that the United States is proud of controlling and regulating the safety accidents relating to school statistically considering human factors and physical factors, we had better adopt the diversity of discipline and regulaton according to the level of each region in America. Furthermore the policies of U.S. are meaningful in preventing the occurrence of accidents in terms of issues as following. First of all, they have the definite subject of discipline by establishing criteria to focus on people who should be trained for the sake of school bus safety in the state law. Thus it is necessary for us to secure differentiated and divisional direction and guidelines at the regional level by considering the case of the United States. It will enable us to have more specific and concrete discipline system through legislations and by-laws. And due to the fact that discipline and consideration on material factors and human ones are necessary as well, we should secure the policies to realize both factors on the related policy. In particular, the former should be considered by installing facilities such as back and inner surveillance facilities and the latter by management and control of the concerned persons. In conclusion, because securing the safety of children's school bus is the main reason for controlling the negligence of the concerned people, it is true that we need to reinforce driver's qualification requirements, expansion of range of persons who should take the education programs and education contents.
