이 글은 직업교육을 헌법적 관점에서 논의한 것이다. 직업교육이 우리 헌법상 어떤 위치에 있고, 헌법상 어떻게 보장되고 있는지 살펴봄으로써, 직업교육의 헌법상 근거와 함께 직업교육의 공공성과 국가책무성의 근거를 찾는데 그 목적이 있다. 지난 수십 년간 우리 사회에서 직업교육은 실과교육이라는 이름으로 일반교육에 비해 차별 받아 왔다. 이는 우리 사회의 뿌리 깊은 학력주의에 기인하는 면이 있으며, 이에 의해 학생들은 수평적 진로 선택이 아닌 수직적 진로 선택을 하게 되고, 따라서 직업교육은 낮은 단계의 진로선택지가 되고 있다. 직업교육에 대한 우리 사회의 차별적 대우는 최종적으로는 국가가 해결해야 할 문제이다. 직업교육이 일반교육과 동등한 가치를 인정받고, 직업교육 선택자의 성장경로를 마련하는 것은 헌법이 국가에 부여한 임무이다. 즉 우리나라의 직업교육은 헌법상 교육을 받을 권리, 직업선택의 자유, 근로의 권리, 복지국가원리 등과 같은 헌법 이념에 기초하고, 또한 교육기본법 제21조 직업교육에 직접적 근거를 두고 있다. 그럼에도 불구하고 현재 직업교육 관련법들은 직업교육에 대한 명확한 개념 정의도 되어 있지 않은 채로 교육과 훈련 영역에서 제각각 운용되고 있다. 따라서 직업교육에 대한 이러한 문제점들을 해결하기 위해서는 헌법과 교육기본법에 근거한 직업교육 관련법의 체계적 정비를 요한다. 오늘날 대부분의 교육은 직업으로 귀결되고, 또한 해당 직업에 종사하기 위한 직업교육이 반드시 필요하다고 할 때, 직업교육은 그 자체가 목적이자 수단으로서의 역할과 기능을 하는 것이다. 직업교육 선택자의 성장경로가 마련되고, 직업교육이 일반교육과 동등한 가치를 인정받을 수 있는 직업교육 체계가 마련되어야 한다. 이것이 바로 직업교육의 헌법 이념을 구현하는 일이다.
Abstract
This study discusses vocational education from the constitutional perspective. It deals with what status job education takes up and how it is guaranteed in the Constitution, aiming to seek the constitutional grounds for the publicness and national responsibility in consideration of occupational training. Vocational education, called practical course education, has been undervalued in comparison with general education in the Korean society for several decades. In some sense, this reflects the credentialism deeply rooted in out society, which forces students to make a choice of vertical career rather than horizontal one. Therefore, vocational education has become the last option for career choice. Its discriminative treatment in the Korean society is an issue which should be addressed ultimately by the nation. It is the obligation of the state assigned by the Constitution that leads vocational education to be recognized as having the same value as general education, and sets a course for growth of those who choose job education. In other words, The vocational education of Korea is based on the constitutional ideology such as the right to be educated, the freedom of occupational choice, the right to work, the principle of welfare state and so on. It also has the direct evidence of Clause 22 of the Fundamentals of Education Act. Nevertheless, the laws relevant to vocational education are operated separately in the areas of education and training, without clear definition of concepts. To solve these problems, it is required to keep systematic maintenance of relevant laws regarding job education on the basis of the Constitution and the Fundamentals of Education Act. These days, education is mostly about occupation and job training is positively necessary to pursue a related profession. In this light, vocational education itself is functioning as a purpose as well as a means. It is required to establish the growth paths for job education choosers and to create the system of occupational education which can be recognized having the same value as general education. Such measures are the way to realize the constitutional ideology regarding vacational education.
