미-중 경제무역협정에 관한 법적 고찰: 성과와 한계

본고에서는 미-중 무역협정의 주요 내용과 법적 성격 및 그 문제점에 대하여 고찰해보았다. 미-중 무역협정은 기술이전 금지, 지재권 보호 강화 등 미국의 요구를 대폭 반영하여 작성되었다. 또한 미-중 협정은 2020년과 2021년에 2017년 기준 중국이 미국으로부터 수입한 물품에 추가하여 200억 달러 어치를 더 수입하도록 규정하고 있다. 이러한 수치가 현실화된다면 중국에 대한 미국의 무역적자는 크게 개선될 수 있을 것으로 보인다. 그러나 미-중 무역협정은 국제통상법적으로 그 실효성과 합법성에 대한 논란을 가져오고 있다. 미-중 무역협정은 자유무역이 아닌 관리무역의 요소를 가지고 있으며, 이는 마치 1980년대 미국이 일본을 압박하던 시절의 수출통제체제를 연상케 한다. 또한 미-중무역협정은 GAT 제24조와 GATS 제5조의 요건을 충족하지 못하고 있어 FTA로서 인정하기 어려우며, 따라서 MFN 위반 주장에 대해 취약성이 있다. 미-중 무역협정상의 분쟁해결 제도가 제대로 기능할 것인지에 대하여도 의문이 있다. 미-중 무역협정에서 규정하고 있는 분쟁해결 제도는 양자간의 협의를 통해 분쟁이 종식되는 것을 예정하고 있는데, 제3자의 개입 없이 양자간의 긴장관계가 순조롭게 완화되고 해소될 수 있을 것인지미지수이다. 어쩌면 분쟁해결절차가 분쟁을 격화시키고 미-중 무역협정 종료를 촉발시키는 시발점이 될지도 모를 일이다.
Abstract
This paper aims at reviewing the economic and trade agrement concluded betwenthe US and China. The agrement, reflecting the US concerns, prohibits forcedtechnology transfer and provides beter protections for intelectual property rights. China is required to purchase more gods and services from the US by at least 20bilion dolars betwen 2020 and 2021 in aditon to a 2017 base amount of importfrom the US. If the target is fulfiled, the trade deficit of the US against China wilbe substantialy reduced. However, the controversy may arise over the legitmacy ofthe agrement. First of al, the agrement contains elements of managed trade whichmay be incompatible with WTO rules. The agrement may also be vulnerable to theclaim of MFN violation because it fails to satisfy the requirements of GAT XIV andGATS V which are FTA exceptions. In aditon, a dispute setlement procedure isproblematic. As the dispute setlement mechanism under this agrement solelydepends upon bilateral negotiations without any intervention of third party, this paperraises a question over whether it would be efective. It may intensify the case andtriger the end to the agrement
